If he sued you it would be a good lesson for you. Regardless of what you think there are laws to protect him. You can believe he would win a whole hell of a lot more than $525 as in most areas he's also due a % of all money made for the entire time x 3.

Until he started this thread, negotiations were open on payment to Fletch. I wanted him to reduce what he asked for because I paid him $582.36 more than he'd earned. He did not do what he agreed to do, yet I let it slide.

Now I am asking him to refund the amount he was overpaid. At the moment he owes me $582.36. If he wants to be paid for his banners, fine. He needs to refund me. I won't send him money when he owes me money.

I was not going to enforce this because I know he doesn't have the money to refund what he owes me. Since he decided to come to GFY about it and break of discussions I will insist on a refund prior to paying him.

bingo we have a winner. if Donny was telling the whole story as I said previously he would have mentioned that after his partner fucked me, I was LOCKED OUT of the site. Donny had no dealings with me as a matter of fact, I remember he was all gung ho about some shoot for Lensman and was out of town and buying a new home. He had no time for me or my tour.

He locked me out and I never heard one number until today and the threads he made on mul;tiple boards saying I was converting at 1:162. Thats all i knew

So let me get this straight...

Donovan had an agreement with Fletch to do a tour and banners for $500 + 50%. But those banners were only to be used to promote that tour, thusly not allowing any other affiliate to take advantage of the banners for their promotional use. Also Fletch agreed to produce more banners that the affiliates could use to promote Donovans program.

Now Donovan is using the banners that were intended to be only for that paticular tour for his other affiliates, thus cutting Fletch out of the loop. Fletch complains and points out that that is technically copyright infringement and Donovan states that he can use them because Fletch didnt comply with his end of the agreement by not making any more banners for the affiliates. Even though Donovan didnt ever ask him too becuase he claims the original work converts like shit so why bother.

Im no lawyer but this one seems kinda obvious. Fletch did everything that was asked of him, Donovan, you didnt ever ask him to do the additional banners. It doesnt matter how well they converted in the first place. The deal was $500 and 50/50. He did the tour. He gets paid $500 and 50/50 and those banners can only be used for that tour. Thats all they are licensed for. How can he uphold his end of the agreement if you never ask him to do any additional work.

If a business goes under you're right the 50% interest is worthless but that doesnt mean you can just go use that work elsewhere. Thats copyright infringement.

Even more damaging to this is you have been caught blatantly lying about the conversions. I assume that the tour converted fine and when you said 1:162 months later you were telling the truth to your affiliates and now to get out of a debt you claim they did terrible. Plus I would think that this is all simple logic and you must know you're in the wrong here, so why not just pay the damn $500. You're causing yourself a ton more than $500 in business by being a tool, which leads me and others in this thread to assume that you dont have it. Either way. No matter how you put it, you're fucking Fletch and yourself in the process.

Off of 22k gallery uniques, I wouldn't expect a sale. At 5% CTR (fairly generous), that would be about 1,100 tour uniques. I don't see how anyone could come to any sort of conclusions, good or bad, based off of 1,100 tour uniques.

Donny wanted an affiliate manager, I am not an affiliate manager. I do design, thats what I do.

He is making you side with him by throwing in little lines like I "agreed to deliver banners every other day"

not the case, we had no deal like that. He and I talked about my presence on gfy would helop him gain affiliates etc, but I was never supposed to be some affiliate manager, or recruiter, or even to hold anyones hand during any of this.

I provide graphics, thats what I do. His partner after this tour, fucked us over. I was then turned off by this deal and even asked DOnny to remove tour. He also locked me out of the site, and I had NO CONTROL OVER ANYTHING to do with it.

He got my design and then it seemed i was not needed.

I was not obligated to provide anything for any duration of time, or anything in regards to consistently providing graphics.

DOnny threw that out, and you bit.

I wanted him to reduce what he asked for because I paid him $582.36 more than he'd earned. He did not do what he agreed to do, yet I let it slide. Now I am asking him to refund the amount he was overpaid. At the moment he owes me $582.36. If he wants to be paid for his banners, fine. He needs to refund me. I won't send him money when he owes me money. I was not going to enforce this because I know he doesn't have the money to refund what he owes me. Since he decided to come to GFY about it and break of discussions I will insist on a refund prior to paying him.

But those banners were only to be used to promote that tour, thusly not allowing any other affiliate to take advantage of the banners for their promotional use. Also Fletch agreed to produce more banners that the affiliates could use to promote Donovans program. Now Donovan is using the banners that were intended to be only for that paticular tour for his other affiliates, thus cutting Fletch out of the loop. Fletch complains and points out that that is technically copyright infringement and Donovan states that he can use them because Fletch didnt comply with his end of the agreement by not making any more banners for the affiliates. Even though Donovan didnt ever ask him too becuase he claims the original work converts like shit so why bother. Im no lawyer but this one seems kinda obvious. Fletch did everything that was asked of him, Donovan, you didnt ever ask him to do the additional banners. It doesnt matter how well they converted in the first place. The deal was $500 and 50/50. He did the tour. He gets paid $500 and 50/50 and those banners can only be used for that tour. Thats all they are licensed for. How can he uphold his end of the agreement if you never ask him to do any additional work. If a business goes under you're right the 50% interest is worthless but that doesnt mean you can just go use that work elsewhere. Thats copyright infringement. Even more damaging to this is you have been caught blatantly lying about the conversions. I assume that the tour converted fine and when you said 1:162 months later you were telling the truth to your affiliates and now to get out of a debt you claim they did terrible. Plus I would think that this is all simple logic and you must know you're in the wrong here, so why not just pay the damn $500. You're causing yourself a ton more than $500 in business by being a tool, which leads me and others in this thread to assume that you dont have it. Either way. No matter how you put it, you're fucking Fletch and yourself in the process.
