So let me get this straight...
Donovan had an agreement with Fletch to do a tour and banners for $500 + 50%. But those banners were only to be used to promote that tour, thusly not allowing any other affiliate to take advantage of the banners for their promotional use. Also Fletch agreed to produce more banners that the affiliates could use to promote Donovans program.
Now Donovan is using the banners that were intended to be only for that paticular tour for his other affiliates, thus cutting Fletch out of the loop. Fletch complains and points out that that is technically copyright infringement and Donovan states that he can use them because Fletch didnt comply with his end of the agreement by not making any more banners for the affiliates. Even though Donovan didnt ever ask him too becuase he claims the original work converts like shit so why bother.
Im no lawyer but this one seems kinda obvious. Fletch did everything that was asked of him, Donovan, you didnt ever ask him to do the additional banners. It doesnt matter how well they converted in the first place. The deal was $500 and 50/50. He did the tour. He gets paid $500 and 50/50 and those banners can only be used for that tour. Thats all they are licensed for. How can he uphold his end of the agreement if you never ask him to do any additional work.
If a business goes under you're right the 50% interest is worthless but that doesnt mean you can just go use that work elsewhere. Thats copyright infringement.
Even more damaging to this is you have been caught blatantly lying about the conversions. I assume that the tour converted fine and when you said 1:162 months later you were telling the truth to your affiliates and now to get out of a debt you claim they did terrible. Plus I would think that this is all simple logic and you must know you're in the wrong here, so why not just pay the damn $500. You're causing yourself a ton more than $500 in business by being a tool, which leads me and others in this thread to assume that you dont have it. Either way. No matter how you put it, you're fucking Fletch and yourself in the process.
