Donovan, YOU not wanting him to live up to his part of the bargain (by your own admission) and him not living up to it are two entirely different things. You can't hold him liable for something YOU didn't want him to do. You also cannot, at your own behest, use his designs ANY WAY YOU PLEASE. They aren't your designs and they sure as hell don't belong to your affiliates. This is akin to giving your affiliates stolen content or non 2257 compliant content to use.
You have a very biased view of how things work in the real world; this was proven with the sonofsam incident. Just like sos mistakenly thought the deal was in Canadian Dollars, I'm sure you mistakenly thought you could use the designs anyway you pleased without giving credit where credit was due or at the very least paying for the designs outright.
