How long would you put up with having your sites down before you would demand the months hosting at no charge?

but i think if its a dos attack aimed at your websites then its up to you to wait or switch hosts, but if its something to do with someone else on your shared server, then just tell them you want to be switched to another server and move to dreamhost

In direct proportion to the amount of cash it costs me. If they are in a price range that dictates they are not oversold pieces of crap then almost any downtime is unacceptable if it is the least bit controllable.

I feel bad because they are trying hard to fix the problems, but they have on dc fixed finally after 3 days and I still am down on another dc.... they brought the servers back up quickly but getting the backups restored and all working properly has taken some time

such a hassle to move, and I have noticed that there seems to be a wave of hacking attacks across a few hosting companies recently

To answer the original question, I highly doubt that if you look at the TOS of your host that you are entitled to a refund.

no, it wasn't targetting me, the problems were on other servers that I had nothing on as well

I even noticed one of my hosts (not the one involved in this problem) showed up with a screenshot of them hacked on one of those Turkish hacker websites

theplanet is one host that actually credits the SLA amount back to your card rather than just applying an adjustment on the next bill. I thought it a little unusual (and based on your statement, it probably is)

couldn't you complain to mastercard that they didn't deliver the service promised and chargeback if they don't treat you properly? I am sure they would rather settle with a disgruntled customer than go through the problems having chargebacks may incur

Of course you could, but all the host has to do is point to the SLA/TOS.

1. I do not deal with theplanet. I scanned their TOS and thought it said a year contract, but upon a second look, I guess I read it wrong. However, Item 7 states a service credit is your sole remedy.

2. A new server has a better chance at a successful chargeback than that of an existing customer.

In our experience, no more than a couple hours per year is what we've seen. If you're having a problem with your sites being down or if you're concerned about them going down, you might want to consider Clonebox, which we're developing to not only serve in a back-up/disaster recovery capacity, but also to monitor your site, and should it go down, it will automatically take over, so your customers won't even be aware of the downtime.

Depends on the problem. I would usually expect it to be back up within 15-30 minutes of contacting them. Up to two hours for major things. After two hours I'd be pissed.

depends on what the host claims. If they guarantee you 99.9 percent uptime, I'd take a year / 8760 hours, divide it by 1000 and after 8,76 hours, I'd demand a refund. (Given that this year has been hassle-free until now)

I am still down on one dc, they got half of my sites back online (one dc)... I have been too busy to harass them everyday on it, but they already have icq and email and tickets so there is no excuse......

I have been loyal to these guys for almost a year, they had better give me some kind of consideration

I don't want to mention their names here because they post here and I prefer to give them 15 benefits of the doubt before I really get too upset(I know I am way too patient)

Unless you are on a dedicated server I don't see that there is any reason to bitch or request a refund. Things happen no matter what the setup. If they have treated you good overall and are working hard to fix the problem then I would stick with them.

If you don't like them just move. Why would a refund of hosting fees make you want to stay with a host that you think is doing a bad job?

Isn't an uptime guarantee based on a monthly period? If so, more than about 0.7 hours / 42 mins would be exceeding 99.9%.

Unfortunately not, at least I still have to find a host guaranteeing it monthly...they all do yearly so the can fuck up really bad once a year.

The refund and guarantee are a joke, since the financial losses due to the downtime exceed the money you get by far.

I am also with the planet, never had a single problem and been with them for years. It is crazy that so many people have problems with their hosting companies.

uptime guarantees cover network and power, nothing to do with an individual server FYI.
No host that I have ever heard of offers an SLA (Service Level Agreement) on actual server uptime because there's no way to without you paying a lot of money and having multiple servers mirroring the same content.

Anyways, so was it just your sites hacked? Could very well be that its one of your scripts' fault because it was insecure and had a hole in it. Very common cause of hacks.
