My CC holder is fully aware that he has a no refund policy posted (I personally think that he put it up after I asked for my money back), but that is not the course my CC holder is persuing.

I would think that one cannot be sued for a chargeback, because only a CC provider can chargeback, and only if it complies with law, and they have their own attorneys, to keep them in compliance with law.

The no refund policy is a hurdle that is a difficult one but is not insurmountable.

you need an actual reason and not 'i didn't read the page to know exactly what i was buying.' whats there to dispute? you bought it and the script works.

he can go after you for the money and also the chargeback fee. you get his product for free and he ends up paying the chargeback fee? makes a lot of sense.

you should take a little responsibility for your own stupidity for not fully reading the page. you're in the adult industry and you should know what kind of an effect chargebacks are having. tons of people do the exact same thing and in the end it just ends up fucking everyone.

I don't know if you are an attorney or have discussed this matter with an attorney (I am not an attorney and I have not discussed the matter with an attorney), but I would think that a CC provider and their attorneys, know what the law is when it comes to chargebacks. I would think that if the CC provider exposed me to a lawsuit that would, in turn, expose them to a lawsuit by me.

Please educate me on the technical legalities. I feel the need to know.

And yes; it was a stupid mistake to purchase a script when I was not completely aware of what the scprit actually does. As for the script making pages as advertised, I don't know because once I learned it merely makes doorway pages, I did not use the script. Thus maybe the script works well, maybe not.

it depends on who u get on the line when u call to do the chargeback. some will put anything through and others won't.

dealing with a 3rd party processor like paypal chances are the chargeback will go through.

so u expect him to shell out the chargeback fee because of your mistake? u made the decision to buy it, it does exactly what it says, and if u already have software similar to it that u don't use, why the hell did u buy it?

take a step back for a minute and think about it. you're punishing him for your mistake.

Pathfinder, you most likely won't get the chargeback/refund you're asking for..even if you didn't go thru Paypal. I think they usually do an investigation of the complaint..but once they are done and know you received the product, it wasn't misrepresented (even though he made it sound like it's the shit when it's not) and the product works, they would deny your refund. A chargeback isn't something they do lightly unless it is for a porn membership ; ) He shouldn't have to pay a chargeback fee and have that on his account because you made a rash decision.

And linkwhateveryournameis.. what makes you think someone would want to take time out of their life to come see your sorry ass in person? I live in Vegas and wouldn't drive down the street to waste time on you..dork!

if it went through paypal, chances are paypal will just let it go through and fine the seller. i've never had a chargeback occur when i used paypal but i know billpoint never contacted me when a sale was in dispute.

i really had no say at all. i was out the product and fined $25.

I had heard/read somewhere that when you sign up with paypal to purchase something, the terms or something state that you can't chargeback. Then again, this was from a non reliable source.

His site still does not clearly identify the script for what it actually does. I did not see any disclaimer at the time of the purchase."

This is PayPal's response to my complaint: "PayPal's Buyer Complaint Policy does not apply to disputes about the
attributes or quality of goods received. As a result, we cannot
reverse the transaction or issue a refund. We encourage you to
continue to work directly with the seller for an amicable resolution."

I purchased the script on 8 Mar and PayPal's response was received on 14 Mar although I was originally told the investigation would take thirty days.

By the way I read PayPal's response "quality of goods received" as meaning that even if you buy something such as script and the script does not work, they will not return your money.

I havent posted here for 48 hours and you people are still ranting and raving about me. I wont give a refund to anyone who cant read?? Fuck business and fuck PR. The person could have easily emailed me and asked me questions before purchasing the script.

This was the only unhappy customer since I started selling it. Besides, there is a disclaimer on the site saying no refunds if the script works. I have watched 74 people call me names. Im one guy selling a stupid web page maker script! If you dont want the script shut your pie hole because I could care less about any of you. Your opinion of me is completely irrelevant.

Do you really think my feelings are hurt when a bunch of complete strangers pass judgement on me. I dont know any of you and thats just fine.

All you people did was help me sell 17 more scripts since I started posting here. My goal was to make enough money to take care of my daughter and my wife. And I did what I needed to do in order to legally take care of my family. People made fun of my child, called me names, and acted like cowards before I ever got mad.

Im not trying to make friends or win a fuckin award. I needed to make money period. For all of you that couldnt mind your own damn business, you can kiss my ass and I hope you suffer in many ways in the future.

I gave the script to the Pope as per your suggestion. The Pope informed me he has made the script available for a free download, so you probably will not get many more sales, from this board.

Anyone who uses it would be a newbie, because the days for submitting doorway pages to SE's are over. Even Webmasters that run Directories will not accept doorway pages.

My CC provider still has the matter under investigation.

I think they usually do an investigation of the complaint..but once they are done and know you received the product, it wasn't misrepresented (even though he made it sound like it's the shit when it's not) and the product works, they would deny your refund. A chargeback isn't something they do lightly unless it is for a porn membership ; ) He shouldn't have to pay a chargeback fee and have that on his account because you made a rash decision. And linkwhateveryournameis.. what makes you think someone would want to take time out of their life to come see your sorry ass in person? I live in Vegas and wouldn't drive down the street to waste time on you..dork!

Besides, there is a disclaimer on the site saying no refunds if the script works. I have watched 74 people call me names. Im one guy selling a stupid web page maker script! Do you really think my feelings are hurt when a bunch of complete strangers pass judgement on me. I dont know any of you and thats just fine. All you people did was help me sell 17 more scripts since I started posting here. My goal was to make enough money to take care of my daughter and my wife. And I did what I needed to do in order to legally take care of my family. People made fun of my child, called me names, and acted like cowards before I ever got mad. Im not trying to make friends or win a fuckin award. I needed to make money period. For all of you that couldnt mind your own damn business, you can kiss my ass and I hope you suffer in many ways in the future. I can take 74 strangers calling me names... can you?? Do us all a favor and move on with your lives and quit acting like you are better than me because you dont even know me. I made almost $1500 after PayPal fees on this messageboard in 96 hours. The Pope informed me he has made the script available for a free download, so you probably will not get many more sales, from this board. Anyone who uses it would be a newbie, because the days for submitting doorway pages to SE's are over. Even Webmasters that run Directories will not accept doorway pages. My CC provider still has the matter under investigation.
