Religious Right Plotting against Federal Judges



I got this in my Free Speech X-press from the Free Speech Coaliton today showing the Religious Right plotting to overthrough our federal judiciary. The federal judiciary is what protects us from becoming a theocracy:

?POWER OF THE PURSE? PLOT AGAINST JUDGES
WASHINGTON, DC -- Americans United for Separation of Church and State has provided the L.A. Times with an audio recording of evangelical leaders discussing tactics for reining in so-called ?activist judges.? Times reporter Peter Wallsten says the taped discussion provides a glimpse of the road map the evangelicals are drafting as they work with congressional Republicans to achieve a judiciary that sides with them on abortion, same-sex marriage and other elements of their agenda.

?There?s more than one way to skin a cat, and there?s more than one way to take a black robe off the bench,? said Tony Perkins, president of the conservative Family Research Council, his comments caught on tape. Perkins described attending a meeting with congressional leaders where the strategy of stripping funding from certain courts was ?prominently? discussed. ?What they?re thinking of is not only the fact of just making these courts go away and re-creating them the next day but also defunding them,? Perkins said.

Instead of undertaking the long process of trying to impeach judges, said Perkins, Congress could use its appropriations authority to ?just take away the bench, all of his staff, and he?s just sitting out there with nothing to do.?

Also caught on tape is Focus On The Family founder James Dobson.

?Very few people know this, that the Congress can simply disenfranchise a court,? Dobson said. ?They don?t have to fire anybody or impeach them or go through that battle. All they have to do is say the 9th Circuit [U.S. Ninth Circuit Court of Appeals] doesn?t exist anymore, and it?s gone.?

Meanwhile, back in Congress, House Majority Leader Tom DeLay lashed out at Republican appointed Supreme Court Justice Anthony Kennedy for being a ?judicial activist.?

?We?ve got Justice Kennedy writing decisions based upon international law, not the Constitution of the United States? That?s just outrageous,? DeLay said. ?And not only that, but he said in session that he does his own research on the Internet? That is just incredibly outrageous.?

Open criticism of individual Supreme Court Justices has been rare for members of congress, but conservative ire over so-called activist judges apparently knows no bounds.

Judges and juries are the only thing standing between most GFY members and prison.

The only good thing about the right wing finally getting rid of the First Amendment by owning the judges would be to see the brainwashed Bush voters on this board in jail.

Yes it is treason.

Bush Says He Favors Decency Rules For Cable


President Bush told the American Society of Newspaper Editors convention Thursday he supported extending broadcast decency standards for television programs to cable and satellite television.

Asked about extending the rules to satellite and cable, Bush replied, "Yes, I'm for that. I think there ought to be a standard. On the other hand, I fully understand that the final edit, or the final decision, is a parent turning off the TV."

In an interview on C-SPAN around the time of his inauguration, Bush seemed to reject measures that would extend rules against broadcast indecency.

"As a free speech advocate, I often told parents who were complaining about content, you're the first line of responsibility; they put an off button [on] the TV for a reason. Turn it off."

At ASNE , Bush said: "I don't mind standards being set out for people to adjudge the content of a show, to help parents make right decisions. Government ought to help parents, not hinder parents in sending good messages to their children. But, look, I mean, we're a free society."

"The marketplace makes decisions. If you don't like something, don't watch it. And, presumably, advertising dollars with wither and the show will go off the air," he said. "But I have no problems with standards being set to help parents make good decisions."

Mr. SANDERS (for himself, Mr. ABERCROMBIE, Mr. PAUL, Mr. BOUCHER, Mr. MCDERMOTT, and Ms. WATSON) introduced the following bill; which was referred to the Committee on Energy and Commerce

A BILL

To prohibit the Federal Communications Commission from imposing penalties for indecent broadcasts on providers of video over cable television systems, satellite carriers, the Internet, or non-broadcast providers.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Stamp Out Censorship Act of 2005'.

SEC. 2. PROHIBITION.

Section 503 of the Communications Act of 1934 (47 U.S.C. 503) is amended by adding at the end the following new subsection:

(c) Indecency Authority Available Only With Respect to Broadcasting- This section shall be construed to permit the Commission to impose a forfeiture penalty under this section with respect to any indecent utterance only if that utterance is broadcast by a radio or television broadcasting station.'.

Worrying about the FCC and the radio is small potatoes comparied to destroying the Federal judiciary. The Federal judiciary is the gatekeeper to the Bill of Rights and OUR right to see, read, and watch whatever we choose in the privacy of our own homes. This is much more serious than dirty words on the radio.

I hate the term "activist judges"

The judiciary is one of the three branches of our government designed to keep the other two in check. That is its purpose for being.

The idea that they're in the wrong for not doing what congress wants is absurd.

It's the independence of our courts that keeps us free. If federal judges were subject to the will of the mob it would be a dark day in America for sure.

Yeah, its funny to hear. I've lived all over the world and there ain't no place like the U.S., still the most free, lowest taxes (of western nations) and best all around government. You think the U.S. government is fucked up? Take a tour of the goverments of Europe, or anywhere else.

A lot of the policies put in by Bush are actually very good and long overdue - zero tolerance for terrorism, bankruptcy reform, and (coming soon) tort reform and an energy policy.

Right now the religious yahoos own the white house and congress. It will pass, with not too much damage done long term. The demographics are too overwhelmingly against the repubs, they squeaked by in the last election by a hair and every year it will become touger and tougher on them.

No surprise ... and you all ( americans I mean ) deserve it ... even if you did vote against ....

After his re-election, I looked carefully at my corporate and personnal structure.

I operate my member sites thru a US corp in Del. and was solely hosted on a US server...

I know am hosted on both US & Canadian servers ( round robin ) and papers selling the member sites from the US corp to my Canadian corp are drawn up and ready to sign...

When ( because it will ) the shit hits the fan, turn off the US servers ( lost business for the US ), turn off the US billing ( use my Euro Billing ) , sign the paper works... and continue operating with as bonus a flow of clients that cannot or will not join US operated sites ....

Your country is politically and morally becoming like a Muslim country, except it is a Christian label. You are always fucking praying ...

What are you going to do?

To combat this threat to our freedoms, I suggest the following:

Support the ACLU, Free Speech Coalition, MoveOn.org and any other individual rights group in your local area. Take the time to go to a meeting and meet other people with the same concerns that you have. You may find those friendships very valuable in the future.

If you don't have cash to support various organizations, then take the time to write a letter, make a phone call, or send an email. It all counts.

What you guys don't seem to understand is the christian right is almost completely impotent in America. All you have to do is look at the RNC convention in 2004. There were absolutely no high profile speeches made by religious conservatives. That was a specific effort by the party to dismiss the christian base

One more example...Terri Shiavo. The republicans could have stopped the courts from starving Terri Shiavo... But the didn't. It's because they don't care about the Christian conservative base anymore.

The judicial appointments have less to do with the culture wars than with corporate interests. The Republicans aren't fighting to put religious zealots on the bench. They're fighting to put business friendly judges on the bench. Judges that won't rule against insurance companies and against "free trade" treaties and practices.

The Bush administration is trying to ditch the christian conservative base in exchange for the spanish speaking immigrant base. Look at hte demographics. If Bush can give amnesty to millions of illegal aliens he can effectively cut off the religious right from the republican party.

I don't understand this paranoia??? Look at TV, Radio, and the internet. It's a fucking porno carnival with no end in sight. I live in Vegas and the mayor wants to make prostitution legal. There is no christianity in America anymore

But you do have to worry about leftist politicans pandering to the christian right to split the republican vote. Hillary Clinton could go after online pornography to move her to the middle of the Democrat party and run for president in 2008. There is more danger to the adult industry from the American Left than from the American Christian right..

These people without a clue I will never understand , everytime a large group of pornographers went to jail it was during republican admins Nixon first and then Reagan. The reason there weren?t high profile Christian speakers giving speeches is because that particular voting base was already locked up and committed to Bush. They intentionally gave moderate or left leaning Republicans their prime time speaking spots because they wanted to appear more moderate and not so extreme. Of course the gullible sheep ate it right up. It wasn?t at all an attempt to dismiss the Christian base, but rather to reach out to Middle America by pretending to be something they were not. All you have to do is look at the platform which has an anti-porn plank to see what they were really all about.

They did on several occasions. The Shiavo case had already been through the Florida Court system and the Federal Court System and there were no more appeals left. Jeb Bush and the Florida legislature decided to make a special law for Terri (knowing it was contrary to the Florida constitution at the time it was passed). So that took another year to go all the way through the Florida court system again where each court in turn said yeah it is unconstitutional. Once that was over Tom Delay and crew decided what was needed was a Federal law mandating the Federal Court system review the case yet again in hopes a whole new trial would at the very least take another 10 years. The Federal judge that first got the case decided he wasn?t going to go along with this horse shit. He reviewed all of the transcripts from the original trial and appeals and decided that there wasn?t a high likelihood of a new trial resulting in a different result, and thus refused to grant the injunction (requiring her feeding tube be reinserted) while a whole new trial was conducted and appealed over the next 10-15 years. Congress can change jurisdiction, but the Trial Rules remained the same. The judge didn?t say the Shiavos couldn?t have their new trial like Tom Delay wanted, but rather that the courts weren?t going to grant an injunction while this new trial was going on. So short of sending in the troops to forcibly reinsert her feeding tube and openly defying a court order (something I understand Jeb was going to order the Florida National Guard to do) there wasn?t anything else they could do. And that is why they are so angry they are discovering there are limits to their power and they can?t just remake the U.S. into Theocracy.

You are simply wrong about this. Many of the judges the current Republican Party is complaining about are Republicans that were appointed by former Republican presidents. They don?t want the judges to follow the law they want the judges to follow their extreme right wing agenda. That is why you see Republicans making comments like they understand the violence against judges. They simply do not want an independent judiciary they want to make the whole country over and they see that the independent judiciary as standing in their way.
