Why not have a color code or icon to pick out the ones that are subject to 2257, but don't comply.

Also, why not step back a bit and say "in my opinion, according to my understanding of my attorney's appraisal of 2257 law. It can't hurt to give yourself a little leeway when saying "these are my competitors who are breakign the law."

Your statements as to who has been reviewed, and who is compliant, make it sound like you are representing the opinions of a legal authority. You aren't.

Hopefully they will. Many already have since the list was posted. I posted the same thread to 5 or so boards and my ICQ, email, and phone have been going off ever since.

Considering this is something that you're not obliged to do.. in effect you are "helping" the competition, I think you've gone above and beyond the call of duty Aaron :) Nice show.

In a country so attorney/litigation scared and a business that is targetted by every do gooder with 5 minutes to spare I do not understand why any US website, webmaster does not absolutely insist on getting the 2257 documents with every purchase.

Forget 2257 it's rarely enforced, usually just added in with the other charges. Here are three scenarios that can and have happened and why you need the 2257 documentation.

(1) The police turn up at your door and ask if you have the proof of age of XZY girl as they have recieved a complaint she is under age.

Option one.
Go to the filing cabinet and show it to them

Option two
Your wife, mother, partner is emailing the content provider while the police are putting you into a cell with your new friends. The local chapter of Hells Angels. The police are telling them why you are there. Pass the lube... :Graucho

(2)
You recieve a writ from an attorney, it seems the content on your site was taken by a boyfriend and the girl had no intention of selling it.

Option one
You fax the attorney the model release, IDs and contract and tell him you will see him in court.

Option two
You contact your attorney by phone and start paying $400 an hour from the second he answers his phone.

(3)
You get an email from the shooter or worse still APIC saying the content on your site is illegal.

Option one
Email them back the documents and ask how come this is.

Option two
Start driving a taxi for a living.

So I made a bit of a joke about a serious matter, but did the message get through?

Aarron
Where are those excellent guys at www.bargainbasementcontent.com ? Or weblegal?

UH...Because the law does not require that. Not only that...BUT...Depending on how the law is read, the webmaster may not even be a secondary producer so them posting their own info may not be 100% compliant.

When I buy content and use it for a website is it OK just to link to the 2257 info of the provider?

And how many TGP submitters aren't compliant? :winkwink:

Your call. I think you should read my previous post on this though.

But what about the rest of the reasons, none of them to do with 2257?

Or are you just waiting for me to reply, another DVD player in the post??

What "accusation" would you be referring to? Checking to see if people comply with the LAW, and stating when they don't? That's neither untruthful nor libelous. It's fact. Period.

There are plenty of stupid attorneys out there who might try. Great idea though....Drag me into a court building where I can tell a judge about how their client is breaking Federal laws.

Yep...Dem be da smert ones. :thumbsup

It is great that they give the name and address of the producer... but what are they doing to verify that information?

Does the broker need copies of all releases and IDs to be fully compliant? .... or can he just pass the responsibility down to the producer?... or worse yet, the producer's agent...

Does anyone know the U.S. law on this?

A very good point, how many brokers just list some shooter 7,000 miles away as the CoR. Very reassuring while the leader of the pack is eying your rear end. Read scenario (1) from above.

youve obviously never been to court regarding libel or slander. A friend of mine had a similar non-compliance list regarding a totally different subject matter and was sued. My friend won but it was a pain in the ass.

Some of the companies listed arent american and dont have to adhere to american laws. That list can be misconstrued which then can give way to libel.

regarding america you can sue over spilled milk.

I do believe most reputable forgeign Content companies as well as American ones have model records on file, (what western country wouldnt have a law like that?) as most ive visited from that list have it in their licensing contracts but not veiwable on the site itself.

bottom line is: have your ass covered.:thumbsup

Heh.. I'm not surprised your friend won. When someone murders someone, in front of witnesses, and someone from a newspaper prints it as fact (which it is) I'm sure the reporter could get sued too, since he's "damaging someone's reputation".

And most reputable foreign content providers do adhere to 2257 laws. Why? Because the majority of their clients are American, and in order to protect their customers, who would essentially take the fall if they don't comply. If you want to keep a loyal customer base in ANY business, you must cater to their needs, whether or not you actually HAVE to. It's just damn good business sense, and for those on US soil who are webmasters, it's the LAW.

Donny 04-23-2003 11:52 AM

I don't even see my name listed one way or the other on that site. Hmmm.....

Most likely because they did not consult with a competent attorney first and now they are getting a slap of reality in their face. The smart ones know it is better to fix it now then to be questioned by the Government later.

Then there are those who act like children and bitch when they are called out on the carpet. I will act like a child in return.

Ah, the fun of webmaster boards. :thumbsup
