Looks like Donny's attorney tried to have some of the charges dismissed yesterday and was denied.

A motion to dismiss a child molestation charge against Donny Pauling was denied Friday.
Yuba County Superior Court visiting judge James Dawson said sufficient evidence exists that the alleged victim was under the age of 14 when molestation occurred.

Defense attorney Roberto Marquez had argued a lack of clarity in the time frame of the alleged act. He raised issue with evidence that the girl moved in with Pauling in February 2011, the same year of her 14th birthday.

A criminal conviction of lewd and lascivious acts against a child under 14 is punishable by more time in prison than against a child 14 or over.

Based on the testimony detectives relayed from the victim during a preliminary hearing, she had vivid memories of the sexual activity occurring before her 14th birthday, Dawson said.
Pauling, who is charged for sexual acts with three minor girls, is scheduled to return to court Aug. 21.

If the case is damning enough my only concern would be about reducing jail time, it says in the article 14 over carries less penalty than under 14.

I don't understand why they have differences for ages. If you are found guilty of molesting a child, it shouldn't matter if the child is three or thirteen.

The prosecution (and cops) frequently pile on charges (overcharge); of course you are going to want to pare the list down before court. I would also guess that they are not admitting guilt but rather pointing out that on the day of the alleged event she was 14.

Eighteen is the age we legally accept someone as an adult. In some states the age of consent is even less.

Wow, here is a sad story. One of the girls Donnie was involved with had parents who were meth addicts, and their children were taken away from them. Deputy Mc Elfresh was involved in the removing of the daughter. Eventually Deputy Mc Elfresh adapted the girl and then this lead up to him eventually being arrested with Donnie.

Sutter County Superior Court Judge Susan E. Green said Wednesday that she did not have enough information to determine whether all three of his cases should be consolidated. She ordered attorneys to return to court to argue the matter, along with other pre-trial motions, on Friday.

Chopra argued the cases should be consolidated in "conservation of judicial resources and public funds."

Green said the issues she must consider are whether evidence in one case would not be admissible in another, whether certain charges in one case are likely to inflame the jury, and whether a "weak" case is combined with a "strong" case.

Green noted one of Pauling's cases is "high profile," a reference to charges that he had sex with a minor girl while former sheriff's Capt. Lewis McElfresh watched and masturbated. That case is scheduled to go to trial Sept. 29.

McElfresh is charged with sex crimes for the incident. Green has been disqualified from hearing that case through a defense motion by Jesse Santana, who has claimed Green holds a bias against him.

The third case against Pauling alleges he provided marijuana to and inappropriately touched another minor girl. That case is scheduled to go to trial Oct. 14.

He's fucked, if he had a top flight attorney who could destroy these witnesses credibility maybe he'd have a chance but I still think any jury is going to convict him, a 40 year old man way too involved in the lives of young teenage girls = where there's smoke there's fire. It won't matter if the girls appear to have given conflicting stories at various times, the jury will be on their side.

Seems to like this was a track record... There was a few cases in the past where he was accused and even arrested, but it seemed like the charges were dropped. When the new charges came up someone looked at his prior record and most likely said "where there is smoke there is fire, and there seems to be a lot of smoke".

Not as evidence since it is purely circumstantial. It might be brought in but even a crappy attorney would object to it being circumstantial and not relevant. Also, considering that he participated in the legit, age verified, adult industry it could play against the prosecution since it demonstrates that he was concerned about legal age limits.

I of course am not an attorney but I do know enough to offer at least a semi educated opinion.

Donny Pauling dismissed his defense attorney less than two weeks before he is scheduled to go on trial on sex charges.

Roberto Marquez filed a motion in Sutter County Superior Court on Thursday requesting he be relieved as attorney of record for Pauling. The motion is scheduled to be heard today.

The jury trial is scheduled to begin Sept. 29.
In a declaration, Marquez said he met with Pauling, accused of having unlawful sex with three minor girls, in jail earlier this week.

Pauling "informed me that he no longer desired my services and that he was discharging me from representing him in his cases in the Sutter Superior Court," Marquez said in the court filing.

Marquez wrote, "There has been an irreparable breakdown in the attorney-client relationship, making it impossible to render effective assistance to Mr. Pauling," the declaration said.

Marquez said he could not comment.

In the motion, Marquez said the attorney may be changed at any time, upon the application of either client or attorney.
