Well... I just listened to 18 minutes of tape over the phone, a conversation between Aaron and Rory. I still don't really know what to make of it all, pretty much just sounded like your typical conversation between two people that happened to be quite frustrated with each other.

Most, if not all, of what Rory posted seems to be true. I gathered whatever I could from the phone conversation, although it wasn't much.

Although, I am pretty confused about the whole "termination of the contract". Aaron basically said on the tape (from what I understood) that he terminated the contract on (or around) August 15th when he told Rory he wouldn't shoot the content without the additional $3k (which Rory refused to pay since he saw no content produced). I don't understand though, if he terminated the contract on August 15th, then shouldn't there be some liquid money somewhere?

I don't know how the content business works, but this whole ordeal somewhat scares me. The deposit from one client was used to foot other bills and shoots. So when shoots for the client come up, who pays for them? The next client? When do you break even? Who knows, I just know that I could never run my business quite like that.

Sure, when I get new roommates I usually spend their deposit, but I always have plenty more in the bank to pay them back quickly if needed. And even if I didn't have the spare cash, it would still be MY responsibility to pay up as quickly as possible, regardless of my other personal expenses that needs tending. But hey, that's just me. I'm well aware that many people don't follow the same principal and have no problems spending money that isn't necessarily theirs.

Aaron made a good point though. His personal and business finances really are nobody else's business. Because honestly, when you're owed money, the other parties other expenses should play little to no role in getting your cash back. It should just be a given that the other party does whatever they need to pony up the dough.

Anyway, make what you will of my little moderation here. I only heard one phone conversation and took it as is, aside from the various threads (including the infamous deleted thread). I take no sides, I just see a guy who wants his money back after a contract termination.

surely, it must be understood that if you pay part in advance, it's because you expect the content provider to make arrangements to begin the shoot - i mean, otherwise you just gave them money as if they were a bank, why would you do that? well, apparently Aaron made those arrangements, and the arrangements had a cancellation clause in them (because the models have to block of time for shoots, too).

so the $750 being taken out seems fair to me, assuming that it was understood that the $2000 was a deposit to get the ball rolling. (i just don't see how it could be anything else.)

you take the deposit from your roommates to cover damages and partially cover unpaid rent, correct? well, in this case, it sounds like the deposit was partially forfeited because the purchaser changed his mind after arrangements were made, which cost the producer money (the purchaser caused damages).

No, not at all. That's what the PREVIOUS deposit was for. Incoming roommates only give a deposit to cover things that they may damage or rent that they skip.

But I do agree with your first post. I never quite understood why Rory gave the $2k in advance, unless he was under the assumption that the ball would start rolling with that money. Which I think he did assume (or think) that.

Well I read the infamous deleted thread, well at least I read Rory's post and a few others.

From what I gathered it was a $5000.00 special ordered content shoot. Something with Kareoke singers and blowjob movies. So I can understand the $2000.00 up front. Who know's if this guy's going to come back, or change his mind, etc.... However, from what I know Aaron came back to Rory "with no content done" and said he needed the other $3000.00 to complete the shoot. Now call me crazy, but that just don't fly with me! Actually, that's bullshit!! I gave you two grand to start, now you want the balance and you didn't start? How would any of us feel if someone did that to you?

Moreover, I understand that it was at that point that the deal fell apart, for one reason or another. Eitherway at that point one party "Aaron" didn't produce on their end.

All the other bullshit is just distractions from what actually happened.

Now I only know of Aaron from these boards. But until today I had a much higher opinion of him. At this point I think he is totally wrong, and wouldn't by anything from him.

R paid A $2000 of $5000 that he was going to pay for a lot of content, that's for certain. There is no explicit mention of this $2000 being a deposit where it would not be returned either in full or in part if the contract is terminated, but this may have been agreed on.

A reads the contract.. $5000 was supposed to be paid in full by 8/15, and the content was to be delivered by 9/15.

A spent that $2000 while waiting for the additional $3000 which R didn't pay because A had spent the money on other things rather than start shooting.

Well, there's no reason why A can't spend the money, however, it would be wise business practice to ensure that he has $2000 on reserve in case of contract termination, and it would have been a "good faith" move to have started shooting with the $2000 already paid, in anticipation of the $3000 forthcomming.

Now, something happened that terminated the contract. R decided he didn't want to pay any more money because A hadn't started shooting with the $2000 he already had and spent, A wanted R to pick up the equipment and the money, R never did, A spent the money on something else and apparently it is gone, and it is unclear if A has an additional $2000 on hand to return.

So, what should be done?

If you ask me, I think Aaron needs to pay. He needs to return the $2000 because no content was delivered and the contract was terminated, that is if the $2000 wasn't explicitly a non-refundable deposit. If the written contract includes a $750 termination fee, then Aaron needs to pay $1250. If the written contract explicitly includes that the initial $2000 of $5000 was a non-refundable deposit, then it has to be determined who exactly terminated the contract and why. If Rory terminated it, then I would say that he forfeits a large portion if not all of the deposit, if that is what it was. If Aaron terminated it, then he needs to refund Rory a large portion of the deposit for breaking the contract.

I still don't really know what to make of it all, pretty much just sounded like your typical conversation between two people that happened to be quite frustrated with each other. Most, if not all, of what Rory posted seems to be true. I gathered whatever I could from the phone conversation, although it wasn't much. Although, I am pretty confused about the whole "termination of the contract". Aaron basically said on the tape (from what I understood) that he terminated the contract on (or around) August 15th when he told Rory he wouldn't shoot the content without the additional $3k (which Rory refused to pay since he saw no content produced). I don't understand though, if he terminated the contract on August 15th, then shouldn't there be some liquid money somewhere? I don't know how the content business works, but this whole ordeal somewhat scares me. The deposit from one client was used to foot other bills and shoots. So when shoots for the client come up, who pays for them? The next client? When do you break even? Who knows, I just know that I could never run my business quite like that. Sure, when I get new roommates I usually spend their deposit, but I always have plenty more in the bank to pay them back quickly if needed. And even if I didn't have the spare cash, it would still be MY responsibility to pay up as quickly as possible, regardless of my other personal expenses that needs tending. But hey, that's just me. I'm well aware that many people don't follow the same principal and have no problems spending money that isn't necessarily theirs. Aaron made a good point though. His personal and business finances really are nobody else's business. Because honestly, when you're owed money, the other parties other expenses should play little to no role in getting your cash back. It should just be a given that the other party does whatever they need to pony up the dough. Anyway, make what you will of my little moderation here. I only heard one phone conversation and took it as is, aside from the various threads (including the infamous deleted thread). I take no sides, I just see a guy who wants his money back after a contract termination.

Who know's if this guy's going to come back, or change his mind, etc.... However, from what I know Aaron came back to Rory "with no content done" and said he needed the other $3000.00 to complete the shoot. Now call me crazy, but that just don't fly with me! Actually, that's bullshit!! I gave you two grand to start, now you want the balance and you didn't start? How would any of us feel if someone did that to you? Moreover, I understand that it was at that point that the deal fell apart, for one reason or another. Eitherway at that point one party "Aaron" didn't produce on their end. All the other bullshit is just distractions from what actually happened. Now I only know of Aaron from these boards. But until today I had a much higher opinion of him. In fact I don't believe the $750.00 is justified on your part but I'm a layman. If it were me I'd be refunding his whole $2000.00 immediately.

There is no explicit mention of this $2000 being a deposit where it would not be returned either in full or in part if the contract is terminated, but this may have been agreed on. A reads the contract.. $5000 was supposed to be paid in full by 8/15, and the content was to be delivered by 9/15. A spent that $2000 while waiting for the additional $3000 which R didn't pay because A had spent the money on other things rather than start shooting. Well, there's no reason why A can't spend the money, however, it would be wise business practice to ensure that he has $2000 on reserve in case of contract termination, and it would have been a "good faith" move to have started shooting with the $2000 already paid, in anticipation of the $3000 forthcomming. Now, something happened that terminated the contract. R decided he didn't want to pay any more money because A hadn't started shooting with the $2000 he already had and spent, A wanted R to pick up the equipment and the money, R never did, A spent the money on something else and apparently it is gone, and it is unclear if A has an additional $2000 on hand to return. So, what should be done? If you ask me, I think Aaron needs to pay. He needs to return the $2000 because no content was delivered and the contract was terminated, that is if the $2000 wasn't explicitly a non-refundable deposit. If the written contract includes a $750 termination fee, then Aaron needs to pay $1250. If the written contract explicitly includes that the initial $2000 of $5000 was a non-refundable deposit, then it has to be determined who exactly terminated the contract and why. If Rory terminated it, then I would say that he forfeits a large portion if not all of the deposit, if that is what it was.
