2+ weeks of waiting and canceling shoots. I cancelled 5 shoots total and paid a $150 kill fee for each shoot. That's $750

Now lets add in the time spent sitting here waiting for you to return calls and emails as well as waiting for you to be here at 11am then calling at 7pm and saying you would be by the next day.

That totals 8 hours. I can shoot 4 exclusive sets in about an hour. 4x8 =32 sets times $450 per set = $14,400

$14,400 + $750 = $15,150 Lets subtract the original $2000 and run with $13,150. Now...Me being the nice guy that I am....I will charge you .25 on the dollar....That totals $3287.50....So, come pick up your shit, cut me a check and the deal is complete. I will not worry about the plethora of other times that you have inconvenienced me or the fact that you are in violation of my copyright since you have failed to returned a single license agreement. How many thousands of images at $750 per image PLUS legal costs......... Petty? Yep, it is but so is this entire thread. You wanna try to attack me publicly then you can deal with the aftermath. I have no reason to cut you any slack at this point.

BUT, if the reason for the deposit is not forthcoming it is due and refundable immediately, UNLESS there is a clause *in* writing that specifically addresses this issue.. stating specifically that there are NO refunds.

Of course, small claims is where you address this issue and even in the case of a written agreement including the clause, the judge may find a reason to refund part or all of the deposit.

Take it off the boards kiddies and either refund the monies and give the equipment back or take it to small claims and deal with it. You'll find no answers here. Anyone taking your side now will only take the other side the next time you have a problem with an associate.

Normal human reaction. Insofar as a deposit, I think that the depositer had no legal right to tell the person that received the deposit what he/she can spend it on. BUT, if the reason for the deposit is not forthcoming it is due and refundable immediately, UNLESS there is a clause in writing that specifically addresses this issue.. stating specifically that there are NO refunds. Of course, small claims is where you address this issue and even in the case of a written agreement including the clause, the judge may find a reason to refund part or all of the deposit. Take it off the boards kiddies and either refund the monies and give the equipment back or take it to small claims and deal with it. You'll find no answers here. Anyone taking your side now will only take the other side the next time you have a problem with an associate.
