The domain that's listed in my letter is one that I don't even own. A friend of mine still owns the domain. He hasn't gotten a letter.

Obviously they didn't get the info from WHOIS.

And as I have stated in another thread, there's a typo consistent with my Matrix info on the letter.

i just got my letter today (postmarked 10/21) and want to throw my 2 cents in... i don't think it was matrix because of the way the name on the letter was formatted... i used my company name, xyz co, Llc... now i never purchased from maxtrix but i have signed up to view their content. i checked the account info when i logged into matrix and my company name was formatted correctly... xyz co, LLC (llc in all caps).... now the ONLY company i know that formats my company name with Llc is ccbill.. i know everyone must have signed up with ccbill before in their life.. can anyone verify their name formatting with ccbill?

Why is everyone still saying they "think" its Matrix?

We've got at least 100+ webmasters easy with a unique address that the letters were addressed to that were only on file in Matrix's database.

They automatically changed the case of the company name.. well in my case anyways. The company name I have on file with Matrix is JSA (all caps), the letter came as Jsa. Also note that I never use a company name when I signup for anything. This was a work related account and it's one of a kind. :2 cents:

I've said it before and I'll say it again. Your statement above is 100% false. I can't speak for everyone as I have not seen copies of other executed licenses, but I do know what we signed.

The license that Hustler and Vivid signed did not ask for affiliate information, nor are we required to provide affiliate information at any time for sales reporting or for any other reason.

Why would they need affiliate information to check sales information? They charge on gross sales, so all they need are general sales reports and/or tax returns.

Acacia clearly got a webmaster list from somewhere, but it was not something that was required from all licensees. At least it wasn't required from us.

This doesn't address the issue of how webmaster information DID get out, but we really don't need more mis-information floating around to add to the confusion and speculation.

My point here is that just because a sponsor settled does NOT mean they are giving up affiliate information. My guess is that the majority of companies who settled were not required or asked for affiliate info.

I believe they have an audit provision in their agreement. That pretty much says they can crawl up your ass if they want to.

I think it's pretty naive to think they'll just say "Ok people, time for your general sales reports! Fax 'em in!"

As for tax returns, what if one has offshore companies that don't necessarily pay US taxes?

I hope you have it in writing that Acacia hereby agrees to accept whatever sales report you give them.

In my opinion they seem to have an ability to say one thing and do another.

First of all, I'm not sure which agreement you're talking about, but I'm pretty sure it's not the one we signed :) I doubt any two Acacia agreements are worded exactly the same.

All of our corps are US based and do file US tax returns. In fact, Hustler has regular audits done by a big 5 accounting firm and has for a long time. I think that would more than get the job done :)

Also, I really don't understand how anyone would use affiliate information to tie into sales reports? We do MAJOR business that does not come from affiliates so affiliate sales data would only give them a part of the equation anyway. I would say that most major programs are in a similar situation.

I can't speak for others, but we are very careful with audit rights in ANY agreement we sign and Acacia will not be looking at our affiliate info for the purpose of an audit or for any other reason.

What you're saying might apply to others (I don't know), but it doesn't apply to us for all of the reasons I stated above.

At some point, they have to believe that the data being provided is true. For us, Tax Returns will more than prove that. They won't need any further detail to collect their fees.

I just think there is enough fear and confusion out there right now and I'm trying to make a point that just because a sponsor or content provider settles does not automatically mean they are required to give up affiliate info, etc.

If you were Acacia would you go after the webmaster/affiliate list from one of the big sponsors or would you go after the webmaster list from one of the top content providers that sells primarily to paysite owners that make a lot more money as a group?

If it is any help, I signed up fo access at Matrix on 09-25-2003. I did not buy anything. If Acacia aquired the list from Matrix, it occurred after that date. I am still of the belief that Acacia pooled names from several lists.

Its not an old list... its a new one. Got me a brand new Matrix account before I left for Vancovuer. Mispelled our company name on accident. Came home from Vancouver, got a letter adressed to a mispelled company name.

All the proof I need. Fuck Matrix.
