A soldier being deployed to Afghanistan is sure to have a lot on his mind, but having squatters take over his home while he is away is probably not high on the list.

But that appears to be precisely what happened to one soldier in Florida.

Michael Sharkey was deployed to Afghanistan two years ago and asked a friend to keep an eye on his home in New Port Richey, Fla. while he was away, according to the local NBC affiliate WFLA.

The soldier, currently station in Hawaii, later learned that strangers moved into the house and now refuse to leave.

?I want the people out,? Sharkey said. ?They?re criminals living in my house.?

WFLA reported that Julio Ortiz and his girlfriend are living in the home and they know Sharkey doesn?t want them there, but Ortiz said he had worked out a deal with the friend looking after the home to fix it up in exchange for living there free of charge.

?I don?t want problems,? Ortiz said. ?We?re not doing anything wrong.?

The soldier?s friend, Lisa Pettus, disputes that there was an agreement. She told WFLA that Ortiz did some work on the home, but she did not know he had moved in until she drove by the house a couple of months later.

?I couldn?t believe it,? Pettus said. ?And now they?re using my name to justify this. It?s wrong.?

Pasco County Sheriff?s Office Spokesperson Ken Doll told WFLA it will take a court order to evict the couple because they have established residency in the home.

?I don?t think I should have to pay hundreds of dollars and go through that aggravation,? Sharkey said. ?I work hard, long hours, and these people never had permission to live in my home. They should be thrown out.?

The couple?s criminal history only adds to Sharkey?s worries.

I'm not seeing the problem. The people living in the house claim there is an agreement in place, and the home owner disputes this. The people in the house are most likely squatting, and eventually they will be evicted.

This is nothing more than a legal matter that needs to run it's course.

As a California resident, you should see what your squatting laws are. Downright scary. Squatters, and even "visitors," have a lot of rights.

There is a easy solution. He owns the home and he can have repairs done on the home. He should have the front door removed in order to repair it. It's also FL, he could temporally have the AC unit removed. Maybe it takes a month to get it fixed..

Not exactly. They are "tenants" now, as insane as it sounds. The rules change once that happens, even Red States. These new "tenants" could sue him and have a pretty good chance of winning.

The renter/tenant game is insane. Tenants have a lot of rights that you would never imagine.

I have a feeling the sheriff's quote was taken out of context and this is just an attempt at clickbait by stimulating anti immigrant or squatter or whatever sentiment.

From the sound of it, the dude who was watching the property maybe gave an ambiguous offer of residence in exchange for this other guy to work on the place. Work-for-rent type thing, who knows which party is lying on that count. The guy did the work, moved in, and now the original owner is pissed and wants his place back because he sure as hell didn't give permission. It sounds like the Ortiz guy genuinely thinks he was shafted as he *did* work on the place - I'd guess he'll probably move out as pressure increases, otherwise yes, the usual way to evict someone who feels they should stay is via court order. It's no big deal, this shit happens all the time and has for decades.

It's just being spun as US-soldier-vs-Mexican-ex-con-thieving-squatter for clicks and good ol' red blooded American outrage.

It's actually laws that are on the book to help deal with abandoned properties. In certain situations squatters can actually get rights to the house. Not in this case mind you, but it can and has happened when the owner abandons the property. It's basically so cities can collect property taxes. Think of places like Detroit for example where people have just walked away from their houses leaving them abandoned.

In fact, one of the reasons I did not invest in rental properties in 2011 ( did buy a condo for me ), but instead did it where I live.

You don't have to pay rent. You just have to be able to prove that this is your primary residence.

My brother went through a situation a few years back where his stepson was supposed to stay with them for a week or two at the most and he never left (its a long story including the stepson going to jail a few times).

Anyway, the stepson (who was 18 at the time) refused to leave. After fighting with him off and on for another few weeks, my brother called the police and since the stepson had some way of proving this was his primary residence the police wouldn't remove him and they told my brother he would have to follow legal eviction proceedings to get him out.

So stepson legally lived in that house. What if I see my neighbors left for couple month and I decide to let some strangers in their house? Will strangers have some rights after neighbors return?
This guy(the owner) was the only one who can allow someone to live in his house. Not his friend. Unless they signed some papers where she had a right to represent him.

I live in Florida and one of my houses was taken over. I called the police and I could not do shit. I went back and there were 8 black guys cooking crack in the kitchen. Well that is about how many I counted after they took off like cockroaches when I big white dude with a shaved head came walking in the front door LOL.
This is a good neighborhood also. Not some run down crack street but there are lots of empty lots between houses so a lot goes unseen.
One bathroom didn't work because they ripped all the copper pipes out to sell for 20 bucks.
Every door kicked in. The shit they lived in. It took a few months to get them all out so I could lock the house up and sell it.
Even when I invited the police in and told them I have a bunch of guys making crack in my kitchen they would not raid my house even with me letting them in. I even offered to go in first LOL

Yea it's pretty fucked, they are supposed to have to show proof of ownership or a rental agreement, but that is easy enough to forge and then they are in and you have fight to get them out because they have rights.

We have the same issue in Canada. Squatters set themselves up all the time in people's homes. Happened to a friend of my wife. He went away for work out west, months later a bunch of teens were in there.. by the time he got back home, it was condemned., the house had to be torn down, it was so water damaged and destroyed. He even knew who the people responsible were but because he can't "prove" it. He lost 50-60k. He said fuck it, local-law wont help him, he moved out west, permanently.

The laws that protect squatters are a bit scary, but you have to understand why they exist. These laws are in place so that a landlord cannot suddenly kick out a renter without warning. If these laws were not in place, the landlord can call the police at any time and have the renters removed by force.

The laws are a result of our lawmakers wanting to protect renters, but in some cases going a little too far. At its core the reason the exist is so landlords can't just show up at your door one day and kick you out of the house you rent by force with no notice.

Squatters set themselves up all the time in people's homes. Happened to a friend of my wife. He went away for work out west, months later a bunch of teens were in there.. by the time he got back home, it was condemned., the house had to be torn down, it was so water damaged and destroyed. He even knew who the people responsible were but because he can't "prove" it. He lost 50-60k. He said fuck it, local-law wont help him, he moved out west, permanently.
