I have a feeling the sheriff's quote was taken out of context and this is just an attempt at clickbait by stimulating anti immigrant or squatter or whatever sentiment.
From the sound of it, the dude who was watching the property maybe gave an ambiguous offer of residence in exchange for this other guy to work on the place. Work-for-rent type thing, who knows which party is lying on that count. The guy did the work, moved in, and now the original owner is pissed and wants his place back because he sure as hell didn't give permission. It sounds like the Ortiz guy genuinely thinks he was shafted as he *did* work on the place - I'd guess he'll probably move out as pressure increases, otherwise yes, the usual way to evict someone who feels they should stay is via court order. It's no big deal, this shit happens all the time and has for decades.
It's just being spun as US-soldier-vs-Mexican-ex-con-thieving-squatter for clicks and good ol' red blooded American outrage.
