GFY laywers ( car wreck question )
my wife and kid got in an accident in another state (her mom was driving )
It happened in oregon and oregon is a "no fault state" so her moms insurance took care of the medical bills and all that today they randomly called and said " we will give you $800 for you and $300 for your child for the injury " they have already taken care of 15k in medical bills I could care less about the 1100 they want to give it will just go into my kids savings account but at this point should I ask for more money or will they just say no more? We never asked for money or anything and they have paid the medical bills so this was kind of a surprise input? ib4 call a real lawyer comment

Speaking from experience, but I am not a lawyer so speak to one.
Absolutly do not accept the offer. You will be signing away all your rights to future compensation for medical bills and for pain and suffering. Insurance companies always have 3 offers for you. Low, medium and high, it's looks like they low balled you with an extra low offer. If they call you again tell them you do not accept their offer and that you will be getting legal consultation. Also do not tell them you want x amount of compensation as they will use this against you in the future. Go talk to a lawyer, the good ones will not charge you for anything and will only take a cut of what you get. The cut may be high as a 1/3 but they will get you way more digits on the offer for a settlement. |

In the uk if somone runs into us, we say, 'ouch, my back, i now have wgiplash'. You then get about £3k.
No one has whip lash. You just say you do. Also having the NHS you do not have any medical bills. Some people drive in front of a car or truck and slam on in order to be hit, so they can make a claim. Some people make a living by doing this.

Do not settle that case or for that matter you shouldn?t even be talking to the insurance company. You need to contact a good personal injury attorney and advise the insurance company accordingly, although I?m sure the attorney will do that. Furthermore, I don?t think you or even an attorney can settle for your child (depending on his/her age) and if they do settle for the child he/she can reopen the case when they reach legal age.

What they do here is send you a cheque for as little as they think they can get away with paying you and word the letter that comes with the cheque so that it says if you cash the cheque that settles the claim.

Yes, to get the money you need to sign a document were they wipe their hands of you and future claims.
The second you bring a lawyer into it, you will lose the $1100 which the lawyer may or may not get for your. If the lawyer does get you the $1100, you will loose a good chunk of it to the lawyer in fees. If nobody is hurt, sign the paper and keep the money! I did with my daughter when she had minor whiplash from an accident (she was fine when I signed it by the way). Check came a couple of days later. |

What they are trying to avoid is a $25,000 settlement for the trauma of simply being in an accident.
Also if your kid ends up having had a brain injury that effects her 5 years from now you can't go back and sue them because you got your $1,100. |

I used to be in the business; I would suggest you check out how no fault states deal with minors. In CA, they have the right to make a claim up until a year after their 18th birthday. Don't sign away your kids rights; you do not know what is going to rear its ugly head in the future. My sister just went through surgery on her neck for something that happened in high school and she is 40 now.

Talk to a PI lawyer. He'll probably recommend your wife and kid see a chiropractor or therapist FIRST before concluding there is no injury. At best, the lawyer can help you negotiate a bigger settlement if there is no injury. If there is soft tissue injury, the settlement HAVE to get bigger.
