GFY laywers ( car wreck question )
my wife and kid got in an accident in another state (her mom was driving )
It happened in oregon and oregon is a "no fault state" so her moms insurance took care of the medical bills and all that today they randomly called and said " we will give you $800 for you and $300 for your child for the injury " they have already taken care of 15k in medical bills I could care less about the 1100 they want to give it will just go into my kids savings account but at this point should I ask for more money or will they just say no more? We never asked for money or anything and they have paid the medical bills so this was kind of a surprise input? ib4 call a real lawyer comment |
The insurrance paid the 15K of medical bill and the state is offering 1100.oo on top of it ?

I'll bet the paperwork you will sign precludes you from any future claims.

Don't settle,talk to a lawyer

Speaking from experience, but I am not a lawyer so speak to one.
Absolutly do not accept the offer. You will be signing away all your rights to future compensation for medical bills and for pain and suffering. Insurance companies always have 3 offers for you. Low, medium and high, it's looks like they low balled you with an extra low offer. If they call you again tell them you do not accept their offer and that you will be getting legal consultation. Also do not tell them you want x amount of compensation as they will use this against you in the future. Go talk to a lawyer, the good ones will not charge you for anything and will only take a cut of what you get. The cut may be high as a 1/3 but they will get you way more digits on the offer for a settlement. |
It's the insurance companies fault they were involved in an accident?
Am I missing something here? |
In the uk if somone runs into us, we say, 'ouch, my back, i now have wgiplash'. You then get about £3k.
No one has whip lash. You just say you do. Also having the NHS you do not have any medical bills. Some people drive in front of a car or truck and slam on in order to be hit, so they can make a claim. Some people make a living by doing this. |
I would get your lawyer to take the call from them. Don't sign anything.
|
Do not settle that case or for that matter you shouldn?t even be talking to the insurance company. You need to contact a good personal injury attorney and advise the insurance company accordingly, although I?m sure the attorney will do that. Furthermore, I don?t think you or even an attorney can settle for your child (depending on his/her age) and if they do settle for the child he/she can reopen the case when they reach legal age.

what do you mean you could care less?
are you confused ? |

My mom had someone hit her while she was stopped at a stoplight. My mom wasn't hurt, the other person's insurance paid to fix her car then the offered her some money ( I can't remember how much). In order to get the money she had to sign a waiver saying she wouldn't sue them for future health or damages from this accident. If you want to see the dollar amount go up ask them if you can wait 6-9 months then take the money and sign the waiver. Tell them you want to make sure there are no lingering problems. lol.:1orglaugh:1orglaugh |
The insurance game is like the tax game. It's too complicated for the average person or even the above-average person to understand.
You need an attorney to review it and explain everything to a level of your understanding before you sign off on anything. |
Put a couple of these on your wife and kid, and get a lawyer.
http://www.clinicwarehouse.com.au/me...83043-2-cw.jpg Hell, put one on yourself for good measure just in case! Seriously though, don't accept that offer. They are trying to give some symbolic amount to try to get you to sign away your rights because they are worried they will have to pay more down the line. |
Do NOT BE A MORON LAWYER UP!
It wont cost you a dime DO IT! |

they may have recorded the conversation. Did you already tell them you would take the $1100?
|
As others say, talk to a professional.
IMHO insurance companies have professional advice, and so should you. Be sure to keep us updated - Good luck! |

Even tho my daughter & wife have no injuries is it still worth getting a lawyer? |
what did you decide?

Yes, to get the money you need to sign a document were they wipe their hands of you and future claims.
The second you bring a lawyer into it, you will lose the $1100 which the lawyer may or may not get for your. If the lawyer does get you the $1100, you will loose a good chunk of it to the lawyer in fees. If nobody is hurt, sign the paper and keep the money! I did with my daughter when she had minor whiplash from an accident (she was fine when I signed it by the way). Check came a couple of days later. |
Get an attorney. You'll make bank.
|
love the attitude on gfy... lets defraud the insurance company* out of as much as possible, even though no one got hurt... :1orglaugh
*everyone is of course too shortsighted to see that fucking insurance company in effect fucks everyone else who is insured... |

What they are trying to avoid is a $25,000 settlement for the trauma of simply being in an accident.
Also if your kid ends up having had a brain injury that effects her 5 years from now you can't go back and sue them because you got your $1,100. |

If it were simple, the insurance companies would not have their law firms writing these things to begin with. |

"Get an attorney. You'll make bank." or " Put a couple of these on your wife and kid, and get a lawyer." they were probably half-joking, but still it seems many people in this thread were jumping with excitement as though OP just hit some insurance jackpot... |
I used to be in the business; I would suggest you check out how no fault states deal with minors. In CA, they have the right to make a claim up until a year after their 18th birthday. Don't sign away your kids rights; you do not know what is going to rear its ugly head in the future. My sister just went through surgery on her neck for something that happened in high school and she is 40 now.

They've offered me more than that after a quick trip to the ER. You can get way more if you go through an attorney. They are not working in your best interest.
|
BTW what if your wifes headaches resume in two years? A lawyer will factor all of that in.
