Then there will be much more railroaded by the injustice of the federal government to come...

Any law with no clear definition is no better then no law at all, as it can be used for selective prosicution and little defence can be mounted to fight it.

good luck to max. everyone takes their own risks. i don't approve of his content, but i think he has a right to do it if its consensual and does not cause pain. if they wanted us all silenced, it would be done already. all the PPV on cable broadcast would be shuttered, all the adult video stores would be raided and locked up. they don't want all of us, just the ones who they can pick off easily using their bland, uninterpretable wishy washy laws. obscenity can never be defined under the guidelines that are set as of now. there is no written black and white. its all left to interpretation. therefore, efforts should be enacted to define obscenity and influence the laws to be clarified. otherwise everyone is a target of selective interpretation at any given time.

Agree with that 100% Define the law if necessary. Obscenity is a crime you can commit without knowing you did it the way it is currwntly written. (Yes, Max new he was on the other side of the imaginary line.) But that's just it, it is imaginary untill the government makes it real.

Because of the community standard rule they will never define the law. This way people in individual communities can define for themselves what they consider obscene. This isn't a terrible thing. If someone wants to live in a sanitized, perfect little town where nobody swears, the milk man delivers milk in a glass bottle every morning and nobody has sex that should be up to them to do. But if they leave that town they should understand that they may see things that could offend them and that their morality shouldn't be forced on the rest of the country.

If the internet convictions stand for Max it would essentially say that at any given time any small community in the country could define for the entire internet what they should and should not be able to watch and they can base that finding and definition on a 20 second video clip.

The community standard rule in general is good thing. When it is applied to anything that does not effect your community it is a terrible thing.

But I'll say this, if it all boils down to a personal view of some elses interpretation of a law that has no real hard fast definition of what is or what is not obscene and that law can also be warped be local/municial law. Then there will be much more railroaded by the injustice of the federal government to come... Any law with no clear definition is no better then no law at all, as it can be used for selective prosicution and little defence can be mounted to fight it.
