Well when I heared about the 2257 upcoming regulations 2 years ago I decided to move to a different country, that was the easy solution....

but the other solution is to have a 3rd party company that sponsors will give IDs to and this company can charge a monthly fee of like $30/month from each webmaster and provide 2257 records for all scenes from major sponsors + 24/7/365 phone support for emergencies etc etc.....

please give me free service if anyone uses my idea.

How was it ignorant?? The law CLEARLY states records must be maintained at YOUR place of business, which means you can't have a 3rd party store them for you...

"You can hire a company to keep your 2257 records, and we will consider that your place of business."

I have not heard a single attorney refute that.

I would love one of the industry lawyers to make a definitive statement one way or the other. However, the 3 that I have spoken with have all said the same thing. The FBI has gone on record with that statement and THEY have heard nothing to refute it either.

So if some 3rd party started becoming custodian for a bunch of different people, if ANY of them have records that aren't accurate (maybe the client puts up content and doesn't add the URLs to the database for example), the custodian could face the 5 years in jail.

Do you think ANY attorney or firm is going to take legal responsibility and put their freedom on the line like that?

They can't be unless they willingly take on that responsibility, and although an attorney would need to verify this as I'm not 100% sure, the way I read it is that the listed Custodian Of Record indeed takes on that burden.

That isn't what the thread is about. It was about the option of having a third party custodian and when the hole 2257 shit hit the fan, there were several companies working on just that.

In a real word 2257 case, specifically GGW, 4 people were charged and sentenced on 2257 violations. Only one of the 4 was the custodian of records. All 4 were company officers. It is not clear if the custodian was charged AS custodian, or as an officer of the company.

Your idea is obvious and the reason no one has done this obvious idea is it wouldn't work. Even if the FBI is saying they would consider a third party custodian to be your "place of business," they could turn around and say something else tomorrow. Also, someone still has to keep track of every URL that the picture appears on, which is a huge burden and no one is going to do that for $30 per month.
