So if they hold people that break the law why re most being released without charge? Not everyone can live in sunny Iowa growing corn. Most of them were rounded up for being young males in the wrong country. Houses had their doors kicked in at night and men were dragged out and thrown in prison.

What you quoted applies to POW's. The detainees at GITMO are not classified as POW's per the Geneva Convention. In addition, one reason they have not been tried either by Military Tribunal or Civilian Courts is because it has been tied up in the Civilian Courts as to the legality of trying them by Military Tribunal. No.. they were assembled from what has been described as a "battlefield" - not Iowa. And... so far, no trials for any war crimes or anything else.

More have been released than had any evidence collected to establish any trial procedure.

Because many were fighting the US on that battlefield - does not change their status to that of "criminals", "insurgents", "terrorists" nor "detainees". They have their own reasons - whatever they may be. You better ask em.
