What you quoted applies to POW's. The detainees at GITMO are not classified as POW's per the Geneva Convention. In addition, one reason they have not been tried either by Military Tribunal or Civilian Courts is because it has been tied up in the Civilian Courts as to the legality of trying them by Military Tribunal. The wheels of justice sometimes turn slowly.
