Those with outsourced employees in the Philippines
My outsourced employee has requested his "13th month pay," which I know is the law in the Phillipines, but obviously not here.
What have any of you done regarding a request like this? |

13th month pay is already factored in to our rates. We also pay the whole range of govt mandated benefits as well as some optional ones: SSS, Philhealth, PagIbig, etc.
As for days off, there's a lot of govt mandated regular and special holidays. We usually have our employees work those days rather than give them the day off (they'd prefer working). Our payouts to employees on those days are normally 30% to 100% extra over regular rates.

If you knew nothing about it, then it does take the piss, yep they are cheap to employ but you are paying them a decent wage in their country, have you not got some form of signed aggreement that lays out the conditions of employment?

Another thing to keep in mind, the current Filipino government loves to make "long weekends"--ie., a holiday falls on a thursday... so friday is declared a 'special holiday.' So this might piss off a lot of clients. Webmasterlabor.com absorb all these costs and don't pass them to the client and we only give people days off for key international holidays not local ones. Although we are then legally obligated to pay 100% or 30% more as a bonus for those days (% depends on whether its a formal holiday or special holiday), we don't pass these costs on to the client.
Also, people who work from home (webmasterlabor.com is based in a centralized office location--we don't do remote employees) can rightfully claim that their connection goes down because the infrastructure here (specially in the provinces or outlying areas of Manila) is very bad. Sometimes, all it takes is some hard rainfall and internet connection dies for hours. So, don't let these experiences give you the idea that ALL Filipinos are lazy. They're just like any other ethnic group in the world...with the same % distribution re work attitudes. If anyone is concerned about productivity issues, definitely try my friend hahaha's company, iwebmasters.com (I'm assuming this is for adult projects) or other services that give you a CENTRALIZED management structure where the employee is at the work site. If anyone needs MAINSTREAM work on a monthly basis, we do it for a starting rate of $450 a month per person (160 hours and quota system). |

i find it weird for a staff to ask for a 13 month pay or even bonuses
its just really unethical for an outsourced/self employed guy to make such demand i can only identify a number major outsourcing companies out there but are you sure their workers are getting paid in full in term of benefits (SSS, Philhealth, Pag-IBIG, OT, 13th mon. pay, etc)? Better ask your outsourced staff about it. You need to make sure that the monthly fee you send covers all the items that the PH law requires. ![]() |

Interesting. I had a conversation in Curacao about 13th month with someone who handles a large staff. The way they take care of it is very simple -- if the employee is prompt, works hard, etc, AND hasnt taken all the sick days they are allowed by the government to have, then they are paid 13th month.
Otherwise, no dice. And no, it's not hahaha, before anyone asks. I have no idea how he pays his people but the ones that work for him that I have dealt with directly seem very happy, as a side note. |
