Those with outsourced employees in the Philippines

My outsourced employee has requested his "13th month pay," which I know is the law in the Phillipines, but obviously not here.
What have any of you done regarding a request like this?

If you directly employ him and he is on the payroll and you pay SSS and Philhealth for him you would have a Filipino company and be liable. If you have him through an outsource company that should be built into whatever they charge you.

If you pay him direct there would be no obligation but if you want to keep him I would pay it as long as it was reasonable. Also, it is calculated as 1/12 of normal pay from December to end of November following year divided by 12 and that amount paid early December (no fixed Date) so October....yeah right. If he worked leass than a year it would come in way below a full months pay.

Leave a message on 343-483-502 and tell me what work he does and what sort of salary..... and yes they are very lazy and have more holidays than the rest of the world put together

13th month pay is already factored in to our rates. We also pay the whole range of govt mandated benefits as well as some optional ones: SSS, Philhealth, PagIbig, etc.

As for days off, there's a lot of govt mandated regular and special holidays. We usually have our employees work those days rather than give them the day off (they'd prefer working). Our payouts to employees on those days are normally 30% to 100% extra over regular rates.

yeah, it's not a ton of money. but the issue is that i've put a lot of time and effort into training him to do something that isn't the "usual" kind of editing, so in one way he's very valuable to me - but the month-after-month drama over material being late because "i got flooded out" "i was in an accident" "i was in the hospital after being beaten up in a bar trying to get money from someone who owed me" "my (fill in the blank relative) died" "my HD died (for the third time this year)" "my ISP disconnected me for no reason and i have to do my work from an internet cafe/friend's house/etc for the next two weeks so you won't be able to reach me on ICQ" --- makes me feel like it was more than $400-500 dollars in aggrevation and lost work over the year...<sigh>
anyway, i told him that he's working for a US company, and we don't do 13th months, we do Xmas bonuses, and that's when he'll get his bonus. hopefully that'll take care of it.

If you knew nothing about it, then it does take the piss, yep they are cheap to employ but you are paying them a decent wage in their country, have you not got some form of signed aggreement that lays out the conditions of employment?

On the subject of the Philippines...

Stick fighting is the national sport of the Philippines.

And, we have the excellent domain name [stickingfighting.com] which is for sale. Hit me up if you are interested. It would be great for a martial arts website.

Another thing to keep in mind, the current Filipino government loves to make "long weekends"--ie., a holiday falls on a thursday... so friday is declared a 'special holiday.' So this might piss off a lot of clients. Webmasterlabor.com absorb all these costs and don't pass them to the client and we only give people days off for key international holidays not local ones. Although we are then legally obligated to pay 100% or 30% more as a bonus for those days (% depends on whether its a formal holiday or special holiday), we don't pass these costs on to the client.

Also, people who work from home (webmasterlabor.com is based in a centralized office location--we don't do remote employees) can rightfully claim that their connection goes down because the infrastructure here (specially in the provinces or outlying areas of Manila) is very bad. Sometimes, all it takes is some hard rainfall and internet connection dies for hours. So, don't let these experiences give you the idea that ALL Filipinos are lazy. They're just like any other ethnic group in the world...with the same % distribution re work attitudes.

If anyone is concerned about productivity issues, definitely try my friend hahaha's company, iwebmasters.com (I'm assuming this is for adult projects) or other services that give you a CENTRALIZED management structure where the employee is at the work site. If anyone needs MAINSTREAM work on a monthly basis, we do it for a starting rate of $450 a month per person (160 hours and quota system).

You shouldn't pay for anything you didn't agree on before entering into the deal. If you knew this before hand then it must be paid.

i find it weird for a staff to ask for a 13 month pay or even bonuses
its just really unethical for an outsourced/self employed guy to make
such demand

i can only identify a number major outsourcing companies out there
but are you sure their workers are getting paid in full in term of benefits
(SSS, Philhealth, Pag-IBIG, OT, 13th mon. pay, etc)? Better ask your
outsourced staff about it. You need to make sure that the monthly
fee you send covers all the items that the PH law requires.

Interesting. I had a conversation in Curacao about 13th month with someone who handles a large staff. The way they take care of it is very simple -- if the employee is prompt, works hard, etc, AND hasnt taken all the sick days they are allowed by the government to have, then they are paid 13th month.

Otherwise, no dice.

And no, it's not hahaha, before anyone asks. I have no idea how he pays his people but the ones that work for him that I have dealt with directly seem very happy, as a side note.

anyway, i told him that he's working for a US company, and we don't do 13th months, we do Xmas bonuses, and that's when he'll get his bonus. hopefully that'll take care of it.
After 5 months of living there I developed a saying.

Welcome to the Philippines, Have a Nice day !!!

You learn fast that NOTHING is surprising in that country, and I DO mean NOTHING.

It is actually one the appeals that keeps me going back.

What have any of you done regarding a request like this?
I guess the right term is BONUS rather than 13th month.

No wonder people chase you off of boards, you're truely an idiot.

I'm with you Mike. It's where the company is headquartered that rules apply.

I know a bunch of US webmasters who work for companies in Europe and the same goes when the shoe is on the other foot.

I have one filipino from iwebm working for me one month, but I heard such stories already too.
The biggest problem i have, i really dont know if he works as much as he can, because sometimes i see very low productivity on his end.
