Yes, you came to an agreement with Acacia that allowed you and your company to become allies, as opposed to enemies. Now any affiliates pushing your program are automatically allies of Acacia as well. As you probably already know, we webmasters HATE Acacia.

Maybe you don't shave now, but is that something in the future because now you have an extra percentage of overhead? Don't you think this is a waste of money if the patent does get overturned, I mean do you guys honestly feel you will get money back for bogus contracts and monies paid?

You guys keep saying that this is a business decision and you made the business decision, well in a sense affiliates are "partners" in your business. Without them you are nothing, yet did any of your affiliates get questioned if they wanted to take the risk, or fight for your company? Instead you assumed you made the right decisions based on your feelings and ideas vs. what your affiliates want. Why not just talk to your affiliates and have them all chip in $1 of each sale to go to IMPA to fight the patent? There are other ways to accomplish the same goal but the attitude that you truly did this just because of your affiliates is pure BS. Whether someone boycotts you guys or not its their decision and I'm in no way bashing your or your business practices, I just think the attitude of "We did this for you!" is completely wrong.

Most definitely.
They are doing exactly what Berman said they would *not* do... they are going after the content producers, the sponsors who use the content, and the webmasters who link to the sponsors (or use their own bought content to link to sponsors).

Triple dipping.

Truth is you could have decided to fight and remain in business for the long term. Why are those that decided to fight still in business?

Come judgement day the folks that fight this shit will be winnners.
You wont be in the victory circle bro

Whoa shit!

....back to the drawing board.

But you didn't even try. Trust me when I say that there are other companies like yours that are forcing Acacia to sue them by sitting tight. Acacia then has to "spend thousands" to initiate action...... they are trying this BS on hundreds and hundreds of companies, do you think they can afford to sue them all? Get real. By selling out you help nothing, not even yourself in the long run.

And Trey, a thread like this can't have come as a big surprise to you. I'm not sure why you're on here telling people to "get fucked" etc, I mean really... at the time you first decided to settle you must have known somewhere in your mind that there was bound to be a backlash about it.

And, trust me on this one as well..... the companies that DO fight and DO manage to invalidate this patent are going to be raved about as heroes for years to come. Yours however.....

you are just typing the same shit thats been typed for months on the subject.

If its popularity I was seeking, I would kiss everyones ass. I deal with the smart ones that want to make money, and can put the BS aside.

If you choose to not promote me because I 'sold out' then you are the idiot. We pay and convert well. thats all affiliates should give a fuck about.

your heroic attitude is admirable, but get real. when the pressure is on, you would fold like a 2 dollar whore.

This is true if affilates only promote you correct?

If they promote any other programs that acacia has no deal with then that statment is for shit right?

So is this a way of promoting your program down the line, telling webmasters they are safe?

It is you that is not understanding. My point is that you have made a decision that has effected all of your affiliates. Whether you wish to say "we settled but we hate acacia" or "we settled and we love acacia" is irrelevant. It is your actions of choosing not to fight which reflects on all your affiliates. Now if affiliates push your program, they have also chosen to give up on fighting Acacia and just settle.

I am not debating whether this was a good business decision or not, or what I would do in your place. I am showing that AsylumN made a good point when he said:

Do you have to respond to everyone with an attitude? I don't think my post had an attitude at all, nor do I think the comments I made should be labeled as ignorant.

No one said you were shaving, I was simply trying to make a point about increase overhead due to paying off Acacia, but instead of you responding like a business man and re-assuring your affiliates that wouldn't happen you just say my comment was ignorant.

And how many of your affiliates ONLY promote your program? So they cannot be touched through your sites..woopie, that doesn't do anything for the business as a whole. Those same affiliates could still be liable through other programs, granted that is not your concern, but YOUR affiliates CAN still be touched and sued. What would be better for the affiliates is fighting the patent so that all affiliates off yours that also promote other programs are not liable.

Re: sending out 5k emails , who suggested that? Again my comments were geared toward "We did this for the webmasters" yet they had no say in it.

Good luck with your program.

Really, no need to get all defensive with me. I'm not attacking you, I'm merely trying to discuss this with you and put a few other points across. And I have plenty of sponsors that convert well and make me money, none of which are on the list. As I said, many are sitting tight and forcing Acacia to put up or shut up.

Brother, all I can say is you don't know me very well. I've BEEN taken to court before, chose to fight not settle, and won. I've had charges laid against me, chose to fight them, and WON. Put me through hell but I'm a better man for it today. I would rather spend 30 grand on a defence than see some vulture-extortionists walk off with my hard-earned money. After I won I would sue for recompensation of legal costs, duress, financial hardship or anything else my lawyer could dream up.

All I'm saying is it's better to throw in with those who are fighting rather than folding "like a 2 dollar whore" and making the overall fight that much harder.

your perspective on this isnt even valid, because you do not run a program. you didnt have to deal with this shit, you havent seen the numbers. you didnt have to pay a fucking lawyer to work the best deal he could. You arent being sued. Try looking at this like your wallet is at stake here, and not just someone sitting on the sidelines making play calls like its a football game.

Should we stop using ARS now? ARS is using CEmags on their exits, so ARS is supporting accacia aswell now? Fight accacia, don't fight each other.
There is a huge difference, ARS didnt sign.

Well for one you wouldn't see ARS, because ARS doesn't own any of the sites.

Again you're off the mark. You must have missed the part of my earlier post in this thread where I said "this business is my livelihood" and that I have made my living from my online ventures for nearly 5 years now, longer than your program has been in existance. More than twice as long actually. The second the IMPA's paypal link went up, I sent a donation. Why? Because my "wallet" IS in fact on the line. I have over 40 sponsors, if they were to all lose and be put under the hardship of having to pay multiple patent fees they would certainly have to cut my paycheck down.

Bro, we are all in this together. There is no room for squirming here. I am "the affiliate", you are "the program owner"..... big deal. Guys like me are no less an important component in the food chain than you. If you don't know that already, there is yet another reason not to promote you. Do you really not know that?

I have been doing this since 97. not that it matters.

and you dont promote me anyways, so why is it even an issue? Dont worry about what I know, Im obviously doing something right, but I wont get into pissing match with you over my success.

I am not your bro, you are twisting this shit around like I sold everyone out. when in fact its the complete opposite.

So, do you have to open the books up to them? If you do isnt it possible that they will see all your affiliate data? Im sure they would want to see everyone and the numbers they're doing which should produce the overall numbers you try to feed them.

Sounds like they would get your affiliate list from the books considering that is where they will figure out how much you owe them.

You talk so highly of this contract, why dont you post the details of the contract, unless there is something in there you dont want people to see. Stop hiding behind it and produce it so your affiliates can know what you've gotten them into.

No but they send/redirect traffic which would still infringe on the patent issue (so berman claims), dumbass. Since you want to get technical the ppl who provide/manage the actual sites havent signed either and intend to fight it.

Okay fair enough. To me, you and I are just talking here though, I'm not trying to piss with you at all. I'm not sure why you're getting yourself all worked up with the "I'm not your bro" shit, but whatever. I guess all the other shit on this thread has left you somewhat close to snitsville, and i can understand that.

I only currently promote one sponsor on that list, but that too is about to change. The reason this concerns me is because *your* decisions sometimes affect much more than just *your* business. Sometimes *your* decisions affect the entire industry, and this could very well be one of those times. Maybe when other programs see a thread like this they might think harder about the best course of action, who knows. All I know is the more companies who decide to fight, the better the chances of defeating the extortion.

Don't tell me you don't want to see Acacia go down in flames. If you do, then we have that in common.

Hey dipshit, if you have to open up the books you're telling me they don't have access to know who you're paying and how much money you're making? I know if I was in their shoes and I found a fish like you I would make you disclose who sent every single signup so that I can ensure you're not trying to rip me off, kind of like you already did.

You call me a scammer? I'm not the one who uses stolen content on their sites (like you did when you used my screen caps even after I told you that you didn't have permission?).
How about the bill you didn't pay?
How about the excessive spam I was getting from you?
How about the music in your GFY banner that you have, you telling me you licensed the music from the recording studio?

Yet I'm the scammer eh?

You say you're not out for the publicity? Why don't you explain the banner you have up on GFY? You may call it an AD but i'm sure the space could have been better spent promoting the program instead of welcoming yourself back.

I think i'm not worth the time because i'm raising a valid point. Post the contract and shut me (and im sure a lot of other people) up
