Yes, they could sue you. You'll have to get their attention first though, and if they'll win is pretty much anybody's guess. If you have any other reason for using the name than their trademark, it would help.

Parody is an exemption to copyright laws. The most recent big test of this that went all the way to the US Supreme Court was when Luke Skyywalker of the 2 Live Crew made a version of "Pretty Woman." He won because his song "Pretty Hairy Woman" was a parody.

Best thing is to get a new domain name as Disney is a big company and has the money for a lawsuit. If they do sue you and lose, you can lose a good 10,000 in lawyer fees. You don't have the advantages of negotiation like you do when dealing with smaller companies suing you.

more likely what they'd do is take you to WIPO and win the domain through their arbitration process. Unless you are well prepared they would most likely win.

So whats the line between parody and tarnishing someone's image. Not to mention that a sing that aims for a parody is one thing, but a site, listing porn, say he used a duck mascot, isnt really a parody of the character, and sounds more like something along the lines of using the characters fame to profit.

Watch out... famous domain typo squatter John Zuccharini is now going to prison for misleading kids to porn sites. Apparently he owned typos of cartoons that lead to porn. The new law was bundled with the Amber Alert Bill. Pretty heavy penalties.

I think you should get another Domain.

No matter how you look at it, it was regged based on Daffy Duck, there is no way you would be able to win in WIPO, no way in hell. I would certainly sue your ass so expect them to do the same.

Even if you decided to keep it and not have a Duck in your logo wouldnt make the tie in which is what you where going for wasnt it, a play on the characters name?

I wouldn't touch that domain with a 10 foot pole because it would definately be considered a typo domain.

Daffy has nothing to do with WB. If you uses a duck that is similar in the looks to Daffy Duck, then it might or might not get a letter from WB. He already said, he's not going to be using a duck on his website. So there is no reason I can think of for WB to be looking at his site.

He is using two words "daffy" and "dick". Even though dick and duck are spelled similar, as long as the site has nothing to do with Daffy Duck, he is free and clear.

They'll start out by sending you a cease and desist. Then they'll take it to court, whether it's parody or not. Eventually, either you'll win in court or run out of money. It won't come cheap though.

Someone just fell off the turnip truck. The US has a law about misleading domains and they have been very successful in prosectuting people. I doubt WB will do much more than send a C&D but getting prosecuted by the attorney general's office isn't something I would want to take on.
