Hi Steve,

Of course how you handle your business is up to you, but since you posted his letter I'll assume you're looking for some feedback. Here's mine.

The letter sounds like he's sucking up to you because he's scared. He is scared and he should be, and too bad for that theif. Don't let him or anyone else off the hook. He said himself that he saw nothing wrong with stealing porn. A threatening letter to him is fine but it needs to be followed through. Make him pay.

Next, $1900 is too low. Charge him $1900 for the FINE and the FINE ONLY. Think about it. He's getting away pretty easy, and he's already got lots of your content anyway. Throwing in a lifetime membership is absurd.

Just my 2 cents...

Besides that, WELL DONE SIR...

Sounds like he got the legal paper...and then "found God" about the subject the same way that criminals in prison do.

He wrote that letter to try and "work" Steve and try to get off light by showing "remorse". Fuck him.

Actually, he didn't really know what the attorney wanted. All he knew is that we requested his name from his ISP. He confessed to the whole thing and agreed to pay a fine without any prodding from us at all.

I actually think his feeling like he wasn't hurting the porn industry or doing anything wrong is pretty common. Most people know if they download a copy of a movie that they are doing it illegally, but they don't consider it the same thing when it comes to porn. I have a friend who is a smart guy and does a lot of web design work. We were talking about the case where the producers of The Hurt locker suing people. I was telling him that some porn companies were starting to the do the same thing and he started laughing. He scoffed at the idea of "illegal tubes" or downloading. When I pointed out that porn is no different than a mainstream movie when it comes to copyright protection he thought about it and understood it. But up until then it had never really occurred to him that porn was protected by the same type of copyright. He assumed it was an illicit business so anything goes. I'm sure there are a lot of people out there that feel that way.

kane, I'd say that since most bit torrent sites now have "news" sections and forums where they openly laugh at us and brag about how they can't be stopped....would probably preclude this guy from claiming ignorance on the subject. But that's just my opinion.

For sure, when you read any of those bit torrent sites even the news sites the comments are full of people claiming that ever lawsuit makes them pirate more and they are pirates for life and that they operate in a way that makes then undetectable. So I'm sure a lot of heavy users probably have an idea that downloading porn without paying is wrong, but I think there are a decent number of people (probably casual downloaders or guys like my buddy who don't download at all and just go to tube sites) who never thought about it.

But you are right, most of the heavy users know they are doing something wrong and actually revel in it.

If someone could download a new 55 inch Samsung TV directly into their living room, they would do it -- but they can't, so that's why they go to Best Buy. Legally, I would never admit any wrong doing, contest everything, counter sue and a huge dose of paper work that would overwhelm a team of lawyers.

The dude should be made a sample of for admitting his guilt. Destroy his life, out him as a pervert to the entire community, take out a local newspaper ad detailing his perverted way of life, get the local church involved and keep adding charges.

So far, we've collected from most of the people we've contacted, and we are about to hit another thousand torrent file-sharers. I don't expect to stop piracy, but I will for sure make people pay for my content one way or another.
