Letter from a Bittorrent Pirate
 
This is a letter from a bittorrent pirate who contacted our attorney even before we contacted him.

I did some research and have discovered that this is related to copy right infringement using a Bittorrent client. I also was able to learn about you and your efforts in assisting the adult entertainment industry in defending their way of life by enforcing copyright laws. I read an interview you gave with AVN in September. You came off as a very reasonable person and this is primarily why I chose to contact you instead of waiting for you to find me. You made a comment that "we arent looking to make mountains out of molehills" that I found very encouraging in coming forward.


First of all I do not support stealing of copyrighted material via download. It is for this reason I do not download "mainstream" films or TV shows. I had never thought of pornography to be in the same category. It was not until this past summer that I began to read stories related to the adult film industry possibly going out of buissness due to file sharing. These stories caused my "willfull ignorance" related to dowloading pornography to crumble and it caused me to see there is no difference in downloading a copy of The Hurt Locker from a scene from an adult movie. This realization did not translate into a change in my behavior though.


The bottom line is you have caught me and I am in agreement that I should pay a fine. I would ask you to understand that to be able to participate in this activity, once a file is dowloaded, the user must allow others to download it as well or the user will not be allowed to participate (I think if you dont share they call it "leeching") It is for this reason that I left the files on my computer to share.


The reciept of notification of subpoena on 11/5 was a real wake up call for me and it has caused me to really look at the way I use the internet.In this your campaign has been extremely successfull with me. Make no mistake about it the fine related to this incident will hurt me and I do fear not being able to pay it. I am supportive of your campaign and regret ever engaging in this activity. You have effectively stopped me from ever doing it again and I invite you to monitor my IP address all you want in the future to verify my intentions. Please understand that your efforts in this have scared the 'heck " out of me and I have no plans of ever doing this again. I stopped as soon as I learned what all this is about.


It is my goal that by contacting you, I will save you some time and effort in tracking me down. From your interviews on the net you seem open to negotiating a settlement with each user rather than go to court. It is my hope that we can find a reasonable settlement and my contacting you will be seen to my benefit in any future settlement negotiations.It will be difficult for me to speak with you tomorrow because I cannot make a long distance call from work but I do hope we can come to some agreement. Please advise me on how you would like to move forward.

I am a fan of this punishment as well. The real goal here is to set an example and slow the occurrence of pirating down. Effectively, that's already been done so everything else is just reinforcement.

I would probably opt for more like 5 years... that's still nothin... and give him the five years like jdoughs said...

It'll show you're not an asshole and you're completely willing to work with people, you're just trying to protect your own property :)

Agreed. At least he came up front and admitted his mistakes. Many people fail to be able to do that. I'd cut him some slack and just make him pay for his year or 2 membership.

If you doing this to make money off of these guys then great. But I hope you don't think you will be changing the minds of many people. I'd bet he is 1 in 1,000 that would feel that way.

Seems like if these people were smart they would just go to tube sites where you wont touch them. Not to mention I don't understand the whole download files from people you don't know off of a torrent site, it just seems to beg for viruses.

$1900? is that for people who downloaded it from a torrent site or people who were sharing it with others ?
