SAN DIEGO ? Calling it a "massive copyright infringer," Corbin Fisher has filed suit against Cyprus-based TnAFlix.com, which operates a tube site with both gay and straight content.

Corbin Fisher also targeted in the suit 500 TnAFlix.com members who may have uploaded copyrighted material. Those defendants are named as John Does in the suit.

Will be interesting to see what comes of this part of it. The main block against neutering the tubes is proving that they themselves are uploading the infringing content. Hopefully there's some way through a legal avenue to get these supposed "rogue uploaders" to have to surface, in which case it would hopefully then become apparent that they don't exist.

litigation is the way to stop the tubes in their tracks..

if enough people litigate, only the tubes with purchased content will survive, which isnt many...

the next step will be for content owners to stop doing deals with manwin and make them buy their content...

buying content plus b/w costs is a losing proposition for tubes because they will constantly need to update content to stay fresh which i dont think works out economically for tubes...

It wasn't quite like that. I was begging attorneys to go after them for me since early 2008. But every legal angle was failing. The DMCA was like a giant cock block.

But NOW, coming at it from a new angle has been working. And precedent is being set. I think a lot of it was just that judges and legal people didn't really understand what was happening.
But now EVERYBODY knows what torrents, file sharing, and tubes are.

And every judge that looks at one sees plainly what we all see....thieves monetizing other people's work. The time is exactly right for what is happening.

They WILL settle. Either that or lose everything when they lose their U.S. traffic.
Plus they are openly charging people to download stolen content.

That has been the new "business model" of pirate sites lately now that advertising is drying up.

And the Pirate Bay isn't doing that. The Pirate Bay is hiding behind and pretending to be a "search engine". But their day is coming as well. Nobody has really went after them yet from these new legal angles. All the past attempts were done in a different way.

Things will come around eventually, and then the adult industry will make it's comeback. All that needs to happen is for the ball to get rolling and for one or two laws to change regarding piracy and the wall will fall in one foul swoop. Anyone with the know-how and determination will still find and trade movies and music for free, but the open channels which have made it easy for the masses will tumble down. Which really, would go a long way towards rejuvenating the industry.

I don't agree with what ACTA proposes, but I do agree that legal channels to shut down the distributors of pirated material should be opened up.

Even if a few big players in the international scene were to enact laws like these, and could block the traffic from pirate sites, that's good enough for a start. Even if all they can cut off is US traffic from getting to pirated sites, that's opening up a huge portion of the buying traffic. And we all know if the US does it and shows some success, the UK, Canada, Australia, and propbably more from there will follow down their footsteps...

Hey, the US got Canada to fork over Marc Emery, they can get any country who owes them to fork over people if they press hard enough. It all depends how strong a message they truly want to deliver and how hard they genuinely want to pursue digital piracy. If they one day decide to come at this issue with a head full of steam, shit will start happening...

It's probably a process that will take a good decade, but it will happen eventually. The sooner the better for those whose livings are made off digital content...

It all depends how strong a message they truly want to deliver and how hard they genuinely want to pursue digital piracy. If they one day decide to come at this issue with a head full of steam, shit will start happening...

It's probably a process that will take a good decade, but it will happen eventually. The sooner the better for those whose livings are made off digital content...

Like I say, it depends how hard they want to pursue it. It is a perfect comparison. They wanted Marc Emery bad enough, they got him. Simple as that. What happens if suddenly the US government decides they want to target the fuck out of digital piracy. What happens if they decide piracy is the newest threat to the American dream and the free market and take a hard line on the issue like they did with marijuana prohibition. Get the media behind you, and take a hard line against pirates, chase it like fucking mad. If you're a pirate and they decide to put a giant mark on your back, you best hope you're not living somewhere that owes the states a few favors...

That's all it is going to take, is for the powers to be to take a serious stand against things, and for all the rest of the countries to start stepping into line behind them.

Just because it hasn't happened yet, doesn't mean it won't, and I think the recent talks regarding the ACTA should be sign enough that this is something they're willing to pursue, even if only to open avenues for other goals.

Don't be so sure the current climate regarding online piracy is going to remain this way. If anything you should be able to see plain as day that it won't. It's just a matter of when. People have openly been pushing the boundaries to the breaking point for a long time now. At the moment your opinion stands 100% valid and I agree with you, but if you think this is the way things are going to stay, you are sadly fucking mistaken. Personally I could see this going as long as a decade before anything of serious implication happens, but things ARE moving in that direction...

Cyprus has a very strict trust setup. They can move funds into the trust. And if nobody claims the money, all further claims will be discarded. Also, foreign jurisdictions cannot sue them outside of Cyprus. Will be HARD to collect money there! It's one of the safest offshore jurisdictions, even more so if you're outside the EU.

Oh I should add. TNAFlix originally came from PureTNA, which is owned by Daniel Oded, the same Israeli behind ThePirateBay (though he doesn't publicize that). I believe there are other partners involved, but considering how ThePirateBay is structured I doubt anyone will ever see a cent out of them.
