More bit torrent lawsuits...including an adult content maker

Just read this.

Looks like there are now more lawsuits going after torrent users. One of the companies suing is gay porn content maker Lucas Entertainment.

It looks like they are going after private trackers. I love the quote in the article from the guy that runs a gay porn torrent site: "Our aim is to work in cooperation with the industry, but if the recent stories of further litigation are well-founded it appears some poorly advised studios stubbornly choose to view our Membership as common thieves rather than with respect as potential customers, and as free advertisers and distributors"

I'm glad to see more of this especially from an adult company.

This is all bogus and I don't believe would ever stand up in any court.

So some ambulance-chasing lawyers have the following information:

- an IP address

- a screengrab claiming someone using that IP address has downloaded a file that MIGHT be copyrighted material

I am no lawyer, but I thought in most countries in the west you need *proof* to do someone for a crime?

An IP address and a filename that MIGHT be a file that is copyrighted is not that proof.

a) Open wifi means ANYONE could have used that IP
b) IP spoofing is facile
c) Just because a file is called TOYSTORY3_CAM_L33th4><><0r5.avi doesn't mean that actually IS a copy of toystory

It's sad that these sort of fucking cunt companies can persuade stupid people that blackmailing their POTENTIAL CUSTOMERS is a good look.

Well, it is simple to tell about the file. You simply download it yourself. If you are Disney and the file is called Toy-Story-3.avi you download it and see if it is the movie. If it is the movie than it is your copyrighted material. Pretty simple actually. Also, many torrents have descriptions of what is in them and even allow the users to comment on if this is a real file or not so you can just browse them and see if it is real or not.

As for the users IP addresses, I think the idea of open WiFi, Ip Spoofing etc is pretty uncommon. Sure, there are people who steal WiFi, but I don't think it happens as often as the pro-torrent crowd wants people to believe. If you really are a victim of this type of thing then you can argue that it wasn't you. Maybe you will win, maybe you won't. If you are going to get WiFi you should at least do the due diligence to make sure that it is secure. If a person really has their WiFi taken and someone else downloads movies using it and they get in trouble for it, I fell sorry for them. But I really think that isn't very common and I have never heard of a case where someone has gone to court and used that as a defense. The closest thing I have heard of was a case a little while back where a woman claimed it was probably her sons that downloaded some music and even that was suspect.
