He didn't even mail the videos in question to Tampa. JadedVideo.com mailed them. And at least according to this jury, site trailers can be judged on their own, "taken as a whole" does not mean the entire web site when it comes to the internet. This is bizarre.

Yes, all charges.

After much deliberation by the jury, adult movie producer Max Hardcore, whose real name is Paul Little, was found guilty of 10 federal counts of distributing obscene materials over the Internet and through the mail.

His company, Maxworld Entertainment, was also found guilty on 10 related charges.

I have no problems with Max Hardcore, and hate to see an industry vet go down like this.

But it has to be said: The nail that sticks out gets hammered down.

Why is everyone so surprised? The stuff on his site is disgusting in my opinion, and it is most definitely obscene! Why are you surprised that somebody distributing obscene material is getting found guilty on charges of distributing obscene content?

hopefully we can get some people/judges elected to office in the next couple years who will realize "obscenity" is in the eye of the beholder....& thus not applicable to law

Obscene to some, not to others. In any event, free speech is free speech, obscenity laws are unconstitutional.

But I guess in America, the government decides what we can and can't watch in the privacy of our own homes.

well, because as much as I hate max and his body of work, i believe that if two consenting adults chose to have rough sex and video tape it, they shouldn't be put in jail for it

Just to clarify, I don't agree with it. I think he should be allowed push his shit, it is all legal afterall and I believe in a free market. However, I really don't see why people are surprised...

Because of this:
".....found guilty of 10 federal counts of distributing obscene materials over the Internet..."

That is going to affect all of us.

I really like this quote from a comment on the article...

"Obscenity is the only law, the only one, that you don't know if you've broken it until a jury decides. How can that be constitutional?"

Say hello to conservative America. Its no shocker the jury and jursidiction was selected within Tampa to secure a better chance of a guilty verdict.

He didn't even ship the videos in question to Tampa. The distributor did. The distributor got immunity.

This has to be overturned on appeal.

The government mandates almost everything you do inside "your" home that the bank most likely owns.

If they want to build a new highway, guess whose moving.

If you watch CP on your computer, chances are the FBI will be knocking.

Not allowed to smoke a plant, not allowed to possess tons of shit, not allowed to harbor people, not allowed to grow certain things, not allowed to paint your house any colour you want

Hell, you need permission to cut down a tree! No digging either.

If you want to build an addition to your house, at least a few people need to be greased to make it ok.

They need to know whose living in your house at all times.

You can't use your house as a business, not supposed to sell things on your property, not allowed to own all kinds of different animals..

I mean the lists go on and on.. How surprised can we be that the government wants to control what kind of pornography we watch?

if you want to poke the dog, you must be prepared for the bite.. i never understood why max felt the need to add that little extra, like "i will rape your underage sister" and borderline simulated rape, etc...

i guess we will see what happens on appeal..

in any case, i think it sets another dangerous precedent for this industry...

I get the argument, but they drew the line before too.. No rape, no beastiality, no bleeding, no violence.. You know them all.

In my opinion, if you showed even a porn consumer a full video of all of the above, they would place what Max Hardcore does in the same shoebox.

ruh roh - anybody in the US hardcore porn industry should be feeling more than a little sick right now. that is seriously fucked up no matter how wacked out Max Hardcore's content is - for all we know that jury might have come to the same decision on content that is not that extreme to us in the industry because we are numbed to it all.

why wasn't Jaded Video also charged?

Revolution? Who's with me? JK LOL. We can do it, it's in the declaration of independance...

Yeah, I'm thinking that an appeal is in order here. Good chance of this being overturned.

I'm not shocked by this verdict, though. Seems like in America, porn producers are always getting fucked... no pun intended.

I'm always getting screwed over by the legal system in my area because they know who I am, what I do, and look for every opportunity to mess with me. Last year the city decided to nail me with a "zoning law violation" for shooting nude models in the privacy of my own home and fined me $2,500.00.

Just earlier today I got a notice saying I'm being fined $270.00 for the weeds in my yard being higher than 6", which they're absolutely not (my front yard is way nice), yet all of my neighbor's yards are far worse.

Once the legal system knows who you are, it's all bad news. I feel really bad for Max Hardcore. Hopefully he can fight this verdict.

I agree Jeff! I may find it obscene(which I don't) but it doesn't give the right to invade peoples right to watch it. I'm sure the idea of peeing in someones mouth is totally gross(which it is) but different strokes..different folks..

They got immunity in exchange for testifying against Max. Even though they are the ones that actually shipped the videos in question. They didn't charge Max with shipping the videos to the distributor in CA, JadedVideo.com, they charged him with shipping the videos to FLA. Which he didn't do, Jaded did.

That is going to affect all of us.
This wil be appealed and should go all the way to the supreme court. You can NOT use "community standards" when applied to the WORLD WIDE web. That means some DA in some backwater in Alabama can take Hugh Hefner to court over playboy.com for "obscenity" because in his "community" Playboy is obscene.
