Heads up. This strikes me as not quite so wise... why not a permanent redirect? Otherwise any affiliate who does not go out and find every instance of the old domain will lose sales, right?

Why is he in such a rush to get rid of the old domain?
I doubt even 50% of the affiliates will have switched their links in the 5-6 days between the announcement and the time he's specified for the cutover. |

Ray Edwards here...I am the webmaster for the site. I am really not sure why "Steve Awesome" did not email me regarding his concern before coming to GFY to post this....especially being that he does not have an understanding as to what is going on. However, I will try to clarify a few things.
The name ADP Models was a name that I had used for nearly 3 years until the processing company "ADP" sent me a cease and desist letter in the mail claiming that I was "tarnishing" their trademark. I spoke with a few different attorneys and they all informed me that I should probably change the website name. I don't believe that "ADP" would have ever had a case regarding "trademark infringement" being that both of the names are different from one another but apparently, they have a pretty good case regarding "trademark dilution"...according to the attorneys that I spoke with. It was never really that big of an issue with me being that I had already been thinking of changing the name anyways but just never did. I will never change the website name again though...that's for damn sure. It has been alot of work having to re-watermark all of my content as well as having to perform many other tasks. The company "ADP" are requesting that I transfer the adpmodels domain name over to them and to cease all promotion of the term "ADP". "ADP" are a multi-million dollar company that has been around for nearly 60 years and they process for over 600,000 businesses worldwide so any court would probably side with them instead of with some pornographer running an amateur site and being that I had been thinking of changing the name anyways...I decided to comply with their wishes. Why not? Hell, I was already getting ready to change the name before any of this happened anyways. Not to mention, "ADP" has what is considered as being a "famous" trademark and with that being said, no confusion has to be proven within the marketplace. With most trademark issues, confusion has to be proven to have taken place within the marketplace but not if the company has a "famous" trademark. Apparently, tarnishment alone is enough for them to have a case against you. Try launching an adult site called "porn cola" and see how far you get. Obviously, a porn site has nothing to do with a soft drink but again...coca cola has a "famous" trademark and tarnishment would be enough for them to drag the issue through court...and they would win. Believe me, you would have spent ALOT of money trying to defend your case...only to lose your website and business in the end. I have already spoken with CCBill on SEVERAL occassions regarding the affiliate setup and NOTHING will change as far as my affiliates being paid their commissions nor will their affiliate codes change either. Again, everything has been taken care of. Affiliates will still be able to make sales after the adpmodels domain is no longer active...that is, as long as they are linking to the true amateur models domain. That was the reason for sending out that email to all of my affiliates. I have sent out several emails and started sending them out several weeks ago. Todays date is 4-18-08 and the adpmodels domain is still active. However, I need to transfer it by the 30th of this month. So, no "rowan"...I was not in a hurry to get rid of my domain....I just wanted to give my affiliates plenty of notice so that they could change out any links that needed to be changed....and again, several emails have been sent out regarding this situation. As far as the redirect, I contacted my hosting company to ask them what the best solution would be as far as continuing to receive traffic to the adpmodels domain as well as to the true amateur models domain and they set up the redirect for me. As of now, if anyone signs up with the site through the adpmodels domain OR through the true amateur models domain, they will still be able to gain access to the members area. NOTHING has changed but the website name. Surfers can get to the site through either domain. However, after I transfer the domain name, surfers will have to go to the website which of course, will be the true amateur models domain. I have alot of affiliates that are pulling in nearly 15 (or even more) sales per day....and that's PER affiliate so if you ask my affiliates, nothing has changed at all regarding them getting their commissions and they are very satisfied with promoting the hosted galleries and banners. I don't really see what the big issue is Steve. I changed my website name and instead of letting go of the adpmodels domain too soon....surfers can get to the site through either domain. I am no expert when it comes to redirects but this is the way my hosting company set it up. All I am doing is providing a way for surfers to get to the site that may not have bookmarked the new domain as of yet. The next time you have a question Steve....why don't you try sending me an email instead coming to GFY and trying to make me look as if I am crooked and trying to cheat my affiliates? Believe me, I am the LAST person that would EVER try to fuck over my affiliates. It would just simply never happen. So again, get into touch with me if you have any concerns and they will properly be addressed. The same goes for any of my other affiliates. Again, nothing has changed regarding my affilliates getting paid their commissions or anything like. I have set up everything with CCBill in order for all of my affiliates to continue making sales....as most of them are doing extremely well with and are very happy with being associated with the program. |

And just to let everyone know...most of my affiliates have changed out their links and so far, I have not received any emails from any pissed off affiliates. Sure, there are a few that have not made the link changes as of yet due to the fact that their emails bounced back to me but most of them completely understand my situation and have been more than willing to make the changes.

They are a major multi million dollar company that has offices worldwide and they do not want to be associated with a porn website using the letters ADP as an abbreviated term. Believe me, I have researched all of my options. |

Even if another company truly has TM rights (I'm not so sure ADP does here; -did you contact an attorney? -have you signed anything yet?), one can often negotiate a settlement in which a particular set of urls / emails will continue to function as redirects well into the future.

I just didn't feel like spending thousands upon thousands of dollars trying to fight a case that I would have probably lost in the end....when I had already been planning on making the name change before any of this even happened in the first place. If you cannot listen to the advice of several attorneys that specialize in trademark issues then who can you listen to? The attorneys that I spoke with all informed me that I would have a very hard (if not impossible) case against me so believe whatever you want. It really doesn't make any difference to me. |
