Well, maybe your right about the term "cola" not being trademarked. Now that I think about it, it seems as though at some point in time, I did read that "cola" was not a trademarkable term. There are several soft drink companies that use that term so you may have a point. I was just trying to make my point as far as using a trademarked name as part of your website name that could possibly result in tarnishing against that particular name.
As I stated before...I did speak with an attorney. In fact, I spoke with more than one and they all told me the same thing. Also, as I previously stated, I was already planning to change the name anyways so nobody "scared" me into doing anything. Believe me, that's not my style at all. I just didn't feel like spending thousands upon thousands of dollars trying to fight a case that I would have probably lost in the end....when I had already been planning on making the name change before any of this even happened in the first place. If you cannot listen to the advice of several attorneys that specialize in trademark issues then who can you listen to? The attorneys that I spoke with all informed me that I would have a very hard (if not impossible) case against me so believe whatever you want. It really doesn't make any difference to me.
