Yep, looks like the same designer, it's completely different, but looks similar due to the font and style.

Someone stealing would certainly not invest the time to completely redo a header.

So how was it stolen, if you don't mind me asking? Did he take your graphics, your code, what? 'Cause to me it looks like a DIFFERENT design, where the designer was asked to emulate another design as closely as possible.

Actually, I'd say it's your ego that's playing tricks on you. You're accusing somebody of THEFT, which you cannot prove because what you THINK is a stolen design is in fact only a copy. Are there similarities between the two designs? Sure. Is the one you're claiming to be stolen an EXACT copy of your design? Nope. Accusing people of wrongdoing without proof is a bannable offense on this board. You have provided zero proof. Just an opinion.

They obviously liked your design and tried to emulate it.

But one is a blog and one is a TGP. There are no actual stolen graphics or code. Everything was completely redone.

I don't think there is much you can do about that.

How about take a style, the way how design look in whole? Emulated or whatever else ... It LOOKS similar! That does matter!!!

First designer spent a week to figure out unique good-looking view of site, and second ass-head owner/designer just copy/emulate that pretty look. Why someone trying to make something different than other does, and other ones keep copy/emulating the good ideas and etc in design?

Is it normal today? I suppose it's not. So I prefer to call it's theft ... theft of ideas, styles, the way of look, color sheme and etc.

Actually, from what I understand the client wanted the same look. Sure, there are bonehead designers out there who do nothing but copy others' work, but they don't last very long. Lets be realistic, any level-headed designer will not come up with such a blatant copy for a client and run the risk of having his ass dragged out on boards for it.

Assuming doesn't mean knowing. However, if it's hard to make something unique or not doesn't give anyone the right to wrongfully call people thieves, nor to insult those who don't agree with them. This is a DISCUSSION board, where grown-ups discuss problems. The rest just resort to insults.

From a legal standpoint you are taking about "Trade dress" and without looking closely at the code, it doesn't appear to even be that close.

Other than the header, I just don't see any evidence of wholesale copyright infringement or trademark/trade dress infringement. The header is close but not even an exact match. The page layout isn't the same. And as a consumer, I would not necessarily believe that these two sites are even related, no less be confused by them.

For trade dress in regards to websites, it really has to be an almost exact duplicate that would cause confusion.

The fact that these two designs are so similar makes the copycat designer look extremely lame. If anything, someone should out the designer that thought it was O.K. to duplicate so many design elements without changing anything. Same colors, same logo style, same positioning, same messaging. Lame! You can be inspired by another design and still do something original. This is many degrees off from being original. IMHO.
