How about take a style, the way how design look in whole? Emulated or whatever else ... It LOOKS similar! That does matter!!!
First designer spent a week to figure out unique good-looking view of site, and second ass-head owner/designer just copy/emulate that pretty look. Why someone trying to make something different than other does, and other ones keep copy/emulating the good ideas and etc in design?

I suppose it's not. So I prefer to call it's theft ... theft of ideas, styles, the way of look, color sheme and etc.
