For the record, I'm not going to respond to any comments on this. There's not a point. I won't respond to emails or phone calls because I have better ways to spend my time. I just want to move on to better things.

My commentary

I used to think a partnership with a model was a good idea. After further review, it's a bad idea, because most models don't understand the amount of work that goes into doing a site, and think that if they spread their legs, the subscriptions will come. Adult webmasters know this is not necessarily the case, and also know that talent is a commodity. As someone I know said, "Every day, new models are turning 18."

I didn't comment on this 1) because I was too busy to worry about it, and 2) the one thing I have learned from previous lives is defending yourself on a message board is pointless. Only a couple of people here actually know who I am, and frankly, the impact on site traffic pulling some of the links has been negliable. Why bother joining in throwing shit with people who are insistent on dragging your name in the dirt?

If another webmaster wants to work with her, read through the rest of this, and consider the mob mentality that has been fostered on this message board and other message boards by the active parties -- working with someone that considers posting the comments like what was posted I wouldn't do. I'm sure someone else will, but I would consider getting everything in writing with her and negotiating with her before actually starting a site with her. I do wish her the best going forward, but urge her to consider what it really takes to do it right.

For matters of resolving this, I have FedEx'ed all the content to her, including photos and digitized video on DVD. I did take her site down, and I will work with CCBill to transfer the subscriptions. I'm not going to transfer any more payments because quite honestly, her site generated about 70 subs, and at this point, I would be asking for money to cover for uncharged hosting costs.

Why I didn't respond

Between starting a new full time job, ending a 7-year relationship that's been more like a divorce, having to move, and general depression, the last thing I want to deal with was the site. Some things should take priority over other things.

Why I didn't want to continue the partnership with Kina

I thought everything was okay until two days before site launch (which, for the record, was a week earlier than planned). We had agreed earlier on a 50/50 split of all proceeds of the site verbally, but she decided she wanted to renegotiate, and after final discussions back and forth (most of which I agreed with because I was just tired), most of the revenue was going to her. Most of this is documented through IM threads because she didn't want to discuss these issues over the phone (which, of course, explains why I didn't want to answer her phone calls). After this, she suggested that it was a client relationship (in another IM thread). As you can imagine, that pretty much lead to why I soured over the relationship.

I was mislead in how much she could promote the site, and what her fan base was.

For example, Word Tracker results are for the following models:

Francine Dee - 3579
Akira Lane - 1037
Kina Kai - 175
Ange Venus - 72

There are about 5 to 7 other models on another site I run that drive more keyword traffic than she does.

My costs

We split location costs and MUA costs. She wanted to factor in costume/wardrobe costs, even though she appears in some of the same wardrobe items on other sites. I probably spent (lost) over $1,500. My labor costs for the time was probably over $10,000 if I factor in lost time that I could have spent consulting. During attempts to do custom shoots, she demanded usage of my video equipment (equipment that typically rents for $150 per day).

The work split

I had to edit the video, edit the photos, upload the photos, submit to TGPs, work on SEO, submit to sites because Kina sent me a list. She posted on a blog, and posted to about half a dozen messages boards. Someone else record

For the record, I have log files, so I have a pretty good idea where I posted links and she did.

What does she own?

Technically, she doesn't own anything. U.S. Copyright Law states that it goes to the creator (photographer or designer), which means she owns no rights to the site design, photography, may own some rights to the video but used equipment I own to shoot it, and doesn't own the site programming. I will be sending some of the data (including mailing lists) to her in a zip file, but she will have to go elsewhere to set up another site -- the fact that she doesn't have a site now is not my responsibility.

I'm not going to fight the copyright issue now. Use the photos however you want.

She does own the domain name, has access to switching the DNS, and I will be sending a complete list of subscribers so she can appeal to them to subscribe to the new site -- whenever she sets that up.

Sometimes it helps to vent. It's pointless to vent if no one's hearing you. Of course, as the photographer, you have to be the one to lay down the law and run the show. As the webmaster, sometimes you have to be the hardass. Like any job, it has to all be done right or things go south. Quite often, people don't understand the level of work we have to do, and do indeed think that all it takes is for someone to spread their legs and the money will come rolling in. If it were that easy, I'd be a billionaire by now...

Personally, I'm too much of a control freak to ever allow a partnership with a model. I gotta be the one in charge, I won't have it any other way. If she was to work with me, it sounds like she's the kind of person who'd get pissed off early and bail because I call the shots at all times. Of course, I don't know her so I can only comment on what's been posted here in this thread...she could be a wonderful person working with me, completely opposite of how she worked with "allasianmodels". People often forget that the chemistry between two people is just as important in business as it is in a personal relationship, and just because you don't work well with someone doesn't mean that they won't work well with someone else.

She was pretty specific in what she wanted and her demands, and didn't seem be interestesd in really putting in the work herself for what's required (common model thing). It's her image, she should do the promotion.

I'm a control freak too, and I've decided that I'm just going to do my own thing (and pay the models outright). Not worth trying to do the partnership thing, even when doing some of the other deals, plus I want a fair control. At least I'm not dependent on anyone else doing any work.

Hey guy. You asked for an apology that really wasn't needed from me. I will not apolgize for an industry with unprofessionals as you seem to be. I think you know who needs to make one. Now here's the deal boy!

- Pay Kina for February. (Got a habit or something to support?)

- Return her access to the CCBill account. (Hiding income?)

- Return her portfolio. (Stealing it?)

- Call or contact her and settle this. (avoiding agreed deals?)

- Respond to posts, don't give me the phone shit. (People lie on the phone. I want to see it in black and white. Besides you seem not to answer the phone dealing with client inquiries.)

- Never ever hit on a model again in a relationship with someone else. (A pro needs no side jollies. Do you know what professionalism is? Get your own GF or BF.)

- Never tell a model that has set limits to show more pink because you feel the shoot is boring. (Don't pressure talent that has already said this is my limit. You are just the image maker, not the creator.)

- Stop calling Talent at odd hours just to "Talk". (Need a late night jollie? Jerk off!)

Now there are a few things to answer and respond to pal. Yeah I am pissed. Guys like you make us all look bad. I will give you 48 hours to make it good and then I will hit every board I know to settle this and out you. BTW I have all your personal data and may include it. Freedom of information there.

I cannot stand guys that try to screw over talent. I know of quite a few webmasters and agents contacting their talent over your BS now. If you want to stay alive in this biz, take care of your business honestly. BTW I will email CCBill about this too. I don't think they will be too keen on your performance.

Maybe this thread should be titled "Resolving the Kina Kai issue (read before working with allasianmodels)". As I heard you were pretty specific in what you agreed to do with/for her and she was with you. If you are a control freak why didn't you take command of this in January when you just disappeared. Oh, and it is not very professional to post amounts paid to someone publicly. There was no mention of March payment.

All I saw were excuses in your post on this. Depression, break up and feeling sorry for self is not an excuse in business. One thing that gets me curious, why did you take time to drop her access to CCBill and not bother to tell her or even contact her? Is that just a plea of mea culpa or is it because she didn't like late night calls from you over non-biz affairs. Maybe it was because she would not show more pink as you had pushed for a few times. Isn't that considered what she wanted for an "Image" and you decided it wasn't? Maybe your other half left you due to your odd contact times with Kina and probably other talent.

If you are a control freak, well, get yourself in control. "I'm depressed" "I just was broken up with..." and "I was on vacation" are not good excuses. Control of what? It took you over 60 days to even respond to the situation. I can say other photographers I know have rolled their eyes over this whole thing. Nuff said here.

There are a few rare exeptions, but in genral you are totally right: Make her sign a bulletproof contract, shoot as much content as you can in a few weeks as long as she is motivated, pay her by the hour and it's all fine.

There are so many things that can go wrong: New boyfriend, parents find out, grandma dies, someone told her that she's ripped off and you make a fortune, she finds Jesus, she gets pregnant, she gets greedy, she gets bored, she thinks she is a star, she get an ugly tattoo or boobjob...the list goes on and on and on.

Yes, with some girls a partnership may work, but there are so many mentally unstable girls in this industry...it's pretty much like gambling.
