How do you prove you dont own a domain???

Well i got a letter from ARS yesterday saying my account was on hold for copyright infringment.

The domain listed was
http://www.madfuckers.com/jul04/group_a2.htm

I do not own this domain. The gallery layout is very similar to some that i post to tgp's on a daily basis, so i am assuming that the guy who stole my layout was not bright enough to change my account number in the link to ars. I contacted ars and they said i needed to contact apic, so i called him and told him tha i do not own that domain but i dont think he believed me. He said he would look into it.....

So my question is how do you prove you dont own a domain name????

Jason

Now it comes down to ONE question: did you register your domains under your real name, or under a fantasy name/address (like some 80% of adult domains)???

If all your domains are under your real name then you can show that in the whois-listing. If you thought it a good idea to hide your identity then this might be the price you have to pay...

madfuckers.com is registered in the name of Aurora Johnson...

Well guess what..just got an email back. NOW WHAT THE FUCK AM I SUPPOSED TO DO????

It makes no sense to me that your ID would be duped?
There is a clear link that gives that number. As long as the site remains up, I'm afraid the problem isn't ours.
Revenues generated from this site went to you, and therefore we will have to assume otherwise.

Can you check referrer logs with ARS and see how much it actually did generate, probably not much if anything at all.

...don't trust this "on hold" business too much! ARS has a rather clouded reputation, and something similar happened to me with MaxCash some 2 years ago - actually twice. The first time they re-activated the account within 4 days, so the second time I thought "why bother changing all links" --- and I lost another 3k on top of a 4k payment they withheld (only sponsor I ever had trouble with!!! - but with over $7,000 it was an expensive one ) - so my advice: CHANGE YOUR LINKS NOW! Move them to another program! Did you read this: DO IT NOW!

Ask them what evidence they have it IS your domain. It's hard to dispute evidence when you don't know what it is.

Jason - long time no speak - sorry it's on a shitty topic. Dude, you have to talk to ARS, give them a little more details to work with. Looks like all you told them was "That's not mine."

example:

Hi, I've been promoting your sites for a long time, blah blah blah
I have many domain names, all registered with the exact contact info(continue to give examples), I own a paysite, I own (insert estimate here) legal web images, I have been doing this for Blah many years. It is my opinion, and the opinion of several of my professional aquaitences, that this individual most likely copied my gallery layout - also, not only were they dumb enough to steal my work, they didn't even replace my account ID code. To top it off, this individual also used stolen content. Now there is some confusion as to wether I own that domain. I do not, here is my domain list (and give them the list you own), where you are hosted (all still the same place? that would help). Ask to speak to a real live flesh and blood account rep on the phone, too -

Hell, it might not meen much, but I'll vouch for you - I know you for about 3+ years now - and you are not a cheater.

Hey steve whats up! The problem is ars pretty much will not talk to me about it. All they tell me is talk to apic! I have contacted the host and he says hes gonna call apic and let them know i dont own it.

Is APIC really that unprofesional? They cause a major problem for me and then he tells me its not his problem. Was it too hard for them to contact the domains host and then contact ars and realize hmm the domain owner and the ars account dont match up.

So pretty much any one can register a domain use stolen pictures and link to someone elses sponsor id to fuck them over? Is it really that easy to fuck someone over??

APIC - who made them GOD?

Try to contact ColorClimax (in Denmark) about this - they own these pics! I found them reasonable to deal with... May be if you explain the situation to them and ask them to contact ARS you'll get further than dealing thru APIC.

And listen to my advice: MOVE YOUR ADS AWAY FROM ARS until situation is resolved. No better excuse to withhold a few bucks (don't even have to shave your sign-ups).

Well, all I hear are stories like this about APIC, haven't heard of 1 uplifting story about them. oh, lets see them look through all my domains now trying to find copyright infringements b/c I posted this.

i'd tell them to subtract the revenue from the stolen gallery, and let you signup with a second account. they'll make money on the sales that other dude is sending and won't have to pay you. good for them, good for you..?

UPDATE:

I was able to get contact info for the owner of madfuckers.com

I told him to remove all the pages with my ars link code in them and contact the apic guy. he said he would. I just hope this is enought proff i have gathered now...

I have his host contacting apic
I have the owner of the domain contacting apic
I have contacted apic

Is this enough proff for apic?

Maybe apic needs to hire me to check out their copyright infringment claims...

I have always heard horror stories about them..and now i know they are true..

abshard,

You should have told him to remove his galleries because they were obviously copies of yours which he altered.

Glad things have somewhat worked out for you. I think it will just take time for ARS to give in that they are wrong, and that they owe you your money. I hope they apologize too..

Cheers,
Matt

put the domain for sale on ebay and you'll get sued for fraud. This way you'll prove you do not own it
