Serious Advice Needed Please.
Serious advice please. . Sorry for long post, but appreciate any advice on this current situation.
Situation is as follows. Back 2004 I became friends with a couple who ran a couple of businesses. Now lets say that after a while, I realized that one of their URLs wasn?t very good as it was a misspelling of the proper business name. They had this because they couldn?t get the correct spelling as it was already taken. The confusion was more compounded by someone else getting them another misspelling, and that wasn?t very good. So, I have a stroke of genius and realize that there?s a way that the name could be registered up, exactly the same way as they and everyone else, pronounced it. So, I bought it for them, using my credit card, my name, and it belonged 100% to me. I pointed it towards their site, and they immediately benefited from it? When it came up for re registration, I again paid for the re-registration myself, and they continued to gain use of it? I always said that if they wanted to own the name, they should just give me the $20 it had cost me, and it would be theres? It would have been transferred too their account at any time, provided I got my twenty bucks back. They never gave me it. Around this time, my wife and I split up, and I needed a place to stay. Then they offered me job, which was to be low paid, but included accommodation. I took, it but although I did the work, my wages were not that fast at forthcoming? Before long, I was owed a sizeable amount, and all of a sudden they basically threw me out on the street owing nearly a months wages for the work I had done. Luckily I find another job, working for people who are in negotiations with my ex bosses, to buy the business from them, so being short of money, I sell the domain name to my new boss. And they renew it, in their name. However, it remains in the same account, (Mine) as it is in there name, and they own it? Well, the ex bosses decide not to sell, and realize this names due to expire. So, they contact the registrar, AND UNBELIEVABLY, because of the reason that they can produce headed notepaper with the address of the business in the same name, they are granted access to my account, behind my back, and proceed to go in, renew in their names this and a few other domains, and delete approx 6 domains that were in there, some of them to other peoples active pay sites, and proceed to change the name and password, effectively locking me out of my own account, an account that has been used by me, since before I even met these people! After a long call to the registrar, I'm given access back and they restore the deleted domain names. But while they were inside they have renewed, albeit by unauthorized access, this name, and are now claiming that it belongs to them? So, who owns it My new boss, or my old boss? ? My old bosses have there names on it, but my new boss was sold it by me, in good faith? When you go to whois, it says that the names taken, and its available, and that there are NO RECORDS OF OWNERSHIP HELP ! |

And an unbiased third-party, (approved by all parties) could probably best ascertain who the check writer and recipient should be.

This is a very complicating issues. I would believe that technically speaking, the domain name would belong to the one it is registered too.
I am no lawyer but I would think that if the domain name was pointed to the old boss' site and that the whole intent of the domain name was for the benefit of the old boss' business, I would believe that would put you at a huge disadvantage because the case would sway to their benefits. You should have asked them for the $20 before you registered the domain name because when it comes to business, a gentleman's agreement is not worth shit that it is on. As for the non-payment of your wages, if you have documentary agreements of the employment, it would help your case or else it is their words againsts yours. They could easily said that the accomodations and probably the food on the table is made in lieu of a proper salary. Hope you have something to back up your case or else you are just screwed. |

Yeah, I know that its dodgy, but doesnt the fact that the fraudulently entered the account, acted disreptutably while in there, and attemptempted to steel some 47 domains, work against them though ?

I would think that it might be a good idea to talk to a lawyer about this.
From what I understand from law, 'intent' is a very big issue when it comes to ownership and right when things are dodgy. |
