Agreed.
Or perhaps a mediator... by the sound of things there isn't actually competition for the names, rather there is disputed ownership rights. Someone needs to write someone else a check. And an unbiased third-party, (approved by all parties) could probably best ascertain who the check writer and recipient should be.
