Mikey Quit Talking! You have no depth to any of your statements. I gained access to the server. WTF if I didn't have access how would any of the updates get to the site. I didn't delete anything I took my content. I didn't touch any other sites ,designs, logos, templates nothing just my images and videos. "Proof we own the images" seeing how I took the images and I have copywrites to all the images. The only way you would get proof is from me. I don't think thats happened. I'm not sure where your get that i changed your email account ..when we moved servers all the email passwords were reset and an email went out to everyone 2 days before ..but you never check your MB email .. I gave tassy your AOL email. If you never made an agreement with us then why was there a meet to discuss the details ... You made the deal with Ray and I don't have to be there and yes you do have to return calls to a company that is paying you to produce any type of work and I was only calling to discuss the fact that the content was late and of poor quality ... the Lawyers will be handling it and you know that no one that had the authority to give you access to that server did. you had access to the Vega bros server to upload content to ... we gave you a great opportunity and a very large % twice what the content was worth but we wanted to give you a chance as long as we broke even or just made a little on the project. Life isn't a party ..if you think asking for a returned phone call and to have work delivered on time is being your dad ....then you have a lot to learn.

A few thing to be made clear. FTV is in no way involved. The quailty of content isn't the issue my opinion. I belive numbers big or small speak for themselves. I am not partnering up with Newbreed.I am looking into Camspot for Lia19. Someone got that from reading my icqs. But not all the way. I am building my next site. I look at this a learning process. it hard to see all your hard work go out this way and still try to do the right thing and be the bigger person. I wish thing were diffierent for everybody involved.

I want to remain as professional as I can threw all this I hope MB's will do the same. I want to be the bigger person and let content, programs speak for themselves. Please stop using my real name on the boards Mikey.

we moved to webair in Jan .. that was in Oct .. old server ..who gave you access to the new one ... no one should have if they did ...and that still gives you no right to go in and delete content regardless of who's you think it is ..

Alright, i have to step in here! That is fucking crap and you know it. you know damn well that I never gave you access to squat except the dummy server we used to host images for GFY and stuff.

Anyone can take a header from an email and put it on top. Be honest for christ sake, don't fucking lie about shit. Besides the josiejunior/content directory couldn't be accessed from there anyway you would be in the root, and obviosely you know that.

Whom ever gave you that ip and user gave you access to the entire main server of the time (which was a long time ago anyway), i doubt you would know where to go unless directed to.

Lets say you own a store that sells baskets on consignment. I am a basket weaver. I make some, then bring 10 of them to you to sell.

I never get a single fucking penny from you in the intervening weeks.

Seems as if there is a lot of favor towards the person you get along with rather then the actual business part of the whole incident in this thread.

You don't go and take content from active websites without at least discussing the situation with the sponsor first. IF it is your content and you feel you have been swindled, you take it to your attorney. After that IF you win the judgement you'll recieve compensation for what was rightfully yours and also in turn get your content back. If not, well better luck next time and take it as a learning experience.

But, you went in and took it without permission. That was unprofessional and you could very well get some heat for it. Then again im just going off of what you guys have posted in two threads, there may be more to it then what is being said.

THIS is why a model should be.. JUST content..

Taking down someone's content without prior consent is illegal and hurts lots of webmasters in the process. Not only that, if you support Josie so much, why did you rmove the content fromt eh site she makes money form?

Smart move.

She failed on her end to earn the money as far as anyone can tell, but that aside, removing property that is legally theirs is illegal.

Even if it was her property, she has no legal right to go renegade and sabotage property as a whole (the site, which is useless until content is re-uploaded), which she did.

She is no longer employed/partnered with mobbucks. At that point any permissions to access the server (if she had any) would be terminated on that note. It's the same as an ex microsoft employee breaking in after hours once fired to steal code they wrote while employed by microsoft.

The problem is that the law is tricky in a situation like this. Most likely Lia could be found in breech-of-contract (even a verbal agreement can qualify) for not providing the content in a reasonable amount of time and for not contacting her "employer" in a reasonable manner or in a reasonable amount of time (sorry for the redundancy, but that's how law is). Also, even if the content is proven to be hers, she can still be held liable for damages due to the fact that taking down ALL members content on the site, opens MobBucks up to a barrage of lawsuits including False Advertising and Fraud. There is a lot more to it than meets the eye, and sadly Lia may be viewed as culpable either way.

your analogy of making a car payment = repo - doesnt apply to this situation.

I was in a similar scenerio. I took what was rightfully mine from a place of business i was a partner in and sat in jail for what i did later that day for a few hrs till charges were dropped.

got a nice education from my lawyer on this particular situation and would advise those who THINK they know their rights to consult a lawyer before acting on a matter regardless of how right you are - or think you are....

That's what I have been wanting to see... The model release (blacked out personal info) and any contract... Both sides have stated they own the content but the proof is in the paperwork at this point... That's all a judge is gonna look at for ownership, so if this is taken to the "court of GFY" then let us see it also... Until then its much harder to tell who owns what and everyone is just taking sides based on outside loyalties.

Id say MobBucks is the one who is in the right in this particular incident. Seems as if there is a lot of favor towards the person you get along with rather then the actual business part of the whole incident in this thread. You don't go and take content from active websites without at least discussing the situation with the sponsor first. IF it is your content and you feel you have been swindled, you take it to your attorney. After that IF you win the judgement you'll recieve compensation for what was rightfully yours and also in turn get your content back. If not, well better luck next time and take it as a learning experience. But, you went in and took it without permission. That was unprofessional and you could very well get some heat for it.
