What gets me is it's not the program that is doing the spamming, so assuming they killed all affiliates that spam. What's to stop the competition from getting some spammers to send out of bunch of spam promoting those programs to put them out of biz.

From what I understand not all the companies listed spam and they do close webmaster accounts that don?t send compliant emails. Notice some settled while others didn?t, if you didn?t violate the law then no reason to settle.

The cost of settling is far less than the cost of defending yourself against the FTC. If you're not making that much money from mail, it may be a better choice.
