What article did you read? They are not going after child porn, they are going after "obscenity", which means any porn they don't like.

They call it the "Child Exploitation and Obscenity" unit to blur the line between legal porn and child porn. They are talking about going after legal porn.

look, there are going to be some busts.

not on mainstream fucking and sucking hardcore.

but on rough sex, degrading sex, and weird fetish shit, the kind of stuff that members of grand juries aren't accustomed to seeing when they go to the adults only room of their local video rental outlet.

now whether they'll be convictions is another story.

methinks most "convictions" they will get will be people taking a plea deal rather than battling it out in front of a jury.

fact is, if you are busted you LOSE whether or not you win in court because the financial and emotional toll is very heavy.

within this past week i saw some sample vids of some new "hot stuff" of getting some poor girl to drink urine, and puke while she was throat-fucked.

Yes you're exactly right... This time it could be for real because there are a lot of politicians in the Democrat party that will publicly support high profile obscenity prosecutions.

Basically, I fear that there will be an alliance created between the fundamentalist Christian right and certain ambitious Democratic politicians to go after online porn. It's a win win situation for someone like Hillary Clinton. She can appeal to the radical feminists in the far left and wingnuts in the extreme right at the same time. The only people who will get pissed are the youth(who don't vote) and the pornographers (who have no allies)

There are many potential candidates for President in 2008 from the Democratic party that wish to distance themselves from the social liberals and be viewed as moderate. Prosecuting online porn will achieve that political outcome.

LOL, that's not how they operate when they already know any obscenity case is difficult to prosecute.

I wouldn't be surprised if they go after all kinds of sites, even the moderate ones.

So what's the difference of what all these sites are doing with their free TGP galleries for example? None. Everyone does it because there's been zero enforcement against it.

That's great news, before aschroft left office and everyone was waiting for the wave obscentity cases to happen, the DOJ said they had 100+ cases undervestigation then. Nothing happened.

It's all politics. If you been around long enough you will knowthis by now. If they cant win a case againt extreme ass. then the feds are not going to go after your lesser extreme content. We will always have the isolated local case, but this is just more hot air from the DOJ trying to appeal to their right wing fanatical followers.

If I have a hardcore pict online, you can bet you last dollar that I'd use a cc or avs for access, 2257s for the pict, and a disclaimer that looks like the telephone book. How many memberships do you have to sell to pay for a first rate attorney? Try $100,000 worth. A webmaster will probably be somebody's punkass in the federal pen cause attitude don't get you much.

i doubt any jail would be served for an obscenity conviction, but there would be some serious probation and fines

i may be wrong though...which i probably am

Good and sensibel post as always.

If you promote/sell mainstream porn and have all you documents together then you are fairly safe. If you think taking the easy route and going for the sicker stuff then good luck to you.

As for them coming after mainstream, forget about it. Too many voters buy it to want the balance tipped at the next elections.

But until this industry organises itself and comes together to fight as one, this will continue to happen and the few who get picked off will have to face paying the bill or copping a plea. If the industry came together with a united front and fund to fight this we would not have the threat.

How many people here do you suppose could afford a proper legal defense let alone bail even if they are 100% covered with valid 2257, non extreme porn, and so on?
Do people think it will be major sponsors with cash to fight back that will be hit? Or do some people live in the real world and relize a conviction is a conviction no matter how big or small you really are in reality, and after they are done with that person they will become whatever they want them to appear as to the media when they spoon feed them the info.

Obscenity is also just a way to open the proverbial door. For a long time they have pretty much known that an obscenity case is nearly unwinnable. Bigger questions are though, can you afford to fight it, will you continue on after you have been tarnished and branded, do you have every little tax detail in order, and most importantly will you not plea out and take a deal?

Yeah sure everyone has been claiming the sky is falling every few months since 96 or so. Problem is most webmasters would be to young to remember the 80's. So they ignore it and see it all as chicken little behavior and feel they are untouchable and "legal". Reality is your a pornographer and society hates your ass. Sure many like your product but they still will shun and prosecute you.

In doing so, they examine every detail of the defendents income and expenses. If everything isn't 100% correct, they get charged with income tax fraud. If the defendent has any family members working on payroll (or off, hence, tax fraud) or if they are on any corporate documents including as officers, directors or partners, they are usually charged as well.

When the defendent's wife and children are looking at some serious jail time, the Feds will offer to make a deal:

You plead guilty to obscenity even if the content is perfectly legal to keep the family out of federal prison. The obscenity guilty plea will allow the Feds to invoke the Rico provisions that enable them to confiscate all your property, cash, and real estate effectively putting you out of business while lining their pockets. And you sit in prison for a stretch. I think the latest terms have been 7 to 10 years.

The end result: You are out of business, you are in prison, your family is destitue and without you or your support.

Just remember, when they get to your family, they got you by the balls.

SERIOUSLY, what the fuck are they waiting for? they test the water with EXTREME associates and they got their ass handed to them, so some of you here think their next course of action is to go after people who show less offensive stuff? I know you think the govt is stupid but there is no logic in that. They took what they thought was the worse they lost bad... now they will keep talking to keep the religious right happy.

My point is the Feds do not get convictions from juries. They get guilty pleas from people trying to keep family members out of prison. Having family members involved in your business is very dangerous to your freedom.

Don't be short-sighted. When it comes to family, there are many ways they can be involved in your business.

They don't necessarily have to be on payroll. They can be listed as corporate officers, co-signers on your 1040 tax return, or, even be listed as a co-signer on your bank accounts. And, don't forget shared credit cards when you use funds from your business to fund the cards. If you are really making big bucks, they can be the beneficiaries of trust funds, etc.

Just follow the money/document trail and, if, you find a family member, correct it now before you have a problem.

Don't be so paranoid. first of all you have to be doing something wrong. secondly they have to actually start convicting people, which since they fucked up extreme associates they haven't tried anyone since and likely wont unless it is a more extreme defendant. If you get a lawyer worth an ouce of shit he is not going to let you roll over and get fucked in the ass because the govt is telling you they are goin to go after your wife because she is authroized to use your credit card. If the person is not involved (hands dirty) they are not getting anywhere with them and who ever may be in that situation, their lawyer will explain that to them. if your the photographer and your wife is the model and your producing scat, different story but not what your talking about.
