Listen, if someone says to me "I'm gonna kick your white ass!" ... is there anything legally that I can do? Civil court, criminal court? Seriously, and before you go and say 'What are you afraid?', just don't go there. I seriously need your guys' brain power on this one. I'll accept obscure ordinances, etc., no matter how far of a long shot.

you can as far as battery and harassment go but the legalities of reverse discrimination don't really apply.

If you have a "human rights commission" in some cases you can bring charges of racial discrimination there.
We have a human rights commission here in Fort Worth and they handle all kinds of cases.
They are handled through a mediator it is a civil court not criminal but can be very effective.
Also here you can be charged with a "terroristic threat" when threatening violence against another person.
If you think the person is actually going to try and do something you can apply for a restraining order.
Just some ideas.

Allright, I had a scuffle with my neighbor tonight, who happens to be a complete and utter asshole! I know that he only said what he said because he is too dumb to think of anything else except for what is painfully obvious. Moron. Anyways, I am just fed up with it. What if I had said, "I'll kick your black ass!" All of my neighbors are black, and I'll tell you right now, that I would not be welcome here any longer, that's fo' sho'!! Why is it okay for 'non-caucasion' people to be racist, but not the other way around?!

I was getting bullied by a group of kids every day for weeks..
Finally, this guy don says. go find the biggest, baddest, meanest kid in the school & knock his ass out..

I didnt think i could do it & was scared shitless of even trying, but next day, went to school & walked up to frank, who was the biggest & toughest kid in school..(huge for a kid..)I tapped him on the shoulder, 7 when he turned around I sucker punched him so fucking hard his feet lifted & he went flat out fucking cold..My jaw dropped..The whole fucking hallway of students' jaws dropped..Damn it was so fucking quiet after that..

Anyway..I never had a problem since..lol

This theory isnt effective..
Tail lamps have max of 15 amps current & this will not produce spark without metal contact, plus, the density of the fuel is too much for a small spark to cause ignition..
Go with my plan..it's true & tested by the winter hill gang..lol

Not to be rude but if you do try to put this in the hands of the court you probably will get your ass kicked by your neighbor. I'd just let it go and avoid all contact with the person. If it gets out of hand as far as threats and a violation of your property or what not you might be able to get a restraining order. That's about all I can think of.

For it be assault you have to be in immediate fear of bodily harm. If he is coming towards you agressively - and says this - and you believe it - it is assault.

If he means "I am going to kick your white ass" sometime down the line. It is not. As in if he says this as he is driving away - or says it to you on the phone.

Someone comes towards you like they are going to hit you and you see them - and they hit you - assault & battery.

Someone comes at you from behind - and hits you over the head with a beer bottle - and you never saw them - just battery.

Shoot a cap gun at someone and that someone thought it was real - assault only (MAY have gun charges as well), but not battery.

Actually, I have reported this to the police, but I live in Los Angeles and there must be bigger fish to fry other than my resident asshole neighbor. Ah well, I'm used to the police never showing up for neighborly disputes. I have also let my landlord know about this as well, since I live in a 4 plex with this guy. Point is, the available route for a resolution here in LA are pretty worthless, so I was hoping to find a legal loophole or something that would allow for this guy to be taught a lesson. The best I got from here was the descriptions of what costitute assualt and battery, that was actually helpful, thanks guys.

As we speak I am still waiting for my landlord to call me back, so, until then, I'm gonna wait and see.

footnote, the guy runs his own moving company and had his truck blocking everyone's garage but his own, so I knocked on his door and asked if it was his truck and he immediayely got aggressive with me, not the other way around. nd I DID walk away, telling him I was going to call the landlord and as soon as I closed my door is when he yells, "Come back out here and I'll kick your white ass!" AFTER I had walked back inside. I just can't get over how different it would have been if I had said the opposite to him. Jeesh. Hope that clears things up a little.

Hey man,
California has a general law called "uttering threats to commit bodily harm". Go down to your local courthouse and file charges. Make sure the DA who handles the case realizes that the incident was racially motivated and it's possible that he could categorize it as a hate crime (doubtful though). but none the less, he'll still have to show up in court on the Uttering Threats charge... Then he's really gonna beat the shit out of you!
