Serious question, I need your guys' help.
Listen, if someone says to me "I'm gonna kick your white ass!" ... is there anything legally that I can do? Civil court, criminal court? Seriously, and before you go and say 'What are you afraid?', just don't go there. I seriously need your guys' brain power on this one. I'll accept obscure ordinances, etc., no matter how far of a long shot.

I think you may have a hard time convincing a Judge that you were discriminated against by the guy wanting to kick your ass. He'd probly give you a week in the can just for wasting his time.

you can as far as battery and harassment go but the legalities of reverse discrimination don't really apply.
honestly anyone can say they think someone is this or that cause it's an opinion but when it involves a job or cost someone something thats when it's slander. |

If you have a "human rights commission" in some cases you can bring charges of racial discrimination there.
We have a human rights commission here in Fort Worth and they handle all kinds of cases. They are handled through a mediator it is a civil court not criminal but can be very effective. Also here you can be charged with a "terroristic threat" when threatening violence against another person. If you think the person is actually going to try and do something you can apply for a restraining order. Just some ideas. eros |

Not to be rude but if you do try to put this in the hands of the court you probably will get your ass kicked by your neighbor. I'd just let it go and avoid all contact with the person. If it gets out of hand as far as threats and a violation of your property or what not you might be able to get a restraining order. That's about all I can think of.

For it be assault you have to be in immediate fear of bodily harm. If he is coming towards you agressively - and says this - and you believe it - it is assault.
If he means "I am going to kick your white ass" sometime down the line. It is not. As in if he says this as he is driving away - or says it to you on the phone. Someone comes towards you like they are going to hit you and you see them - and they hit you - assault & battery. Someone comes at you from behind - and hits you over the head with a beer bottle - and you never saw them - just battery. California has a general law called "uttering threats to commit bodily harm". Go down to your local courthouse and file charges. Make sure the DA who handles the case realizes that the incident was racially motivated and it's possible that he could categorize it as a hate crime (doubtful though). but none the less, he'll still have to show up in court on the Uttering Threats charge... Then he's really gonna beat the shit out of you! |
