Since a lot of you think I'm a prick anyway.....
...I just can't seem to find any reason for me to cut sonofsam any more slack than what I have already done for him.
Yesterday sonofsam started a thread which basically demanded a license and 2257 documents for a content package that he has yet to finish paying for but that I was kind enough to ship to him in advance so that he could get started on his site design for his project. On top of this, he failed to acknowledge the fact that this was a BULK deal and the contents of the package were explained to him prior to the sale. Another client who bought the identical package just before sonofsam even posted that I clearly defined the contents of this package to him prior to the sale. Now, he has infringed on my copyright which of course would violate any license. When you violate a license agreement, that agreement can be terminated by the person who owns that copyrighted material. What this all boils down to is that if he had paid me in full, he would have received what he wanted without any hassle or drama. Instead, he chose to come to GFY and try to make an example out of me. I am the 3rd well known company/person that he has had major drama with in the last month. There seems to be a pattern here. So...Here I sit at a crossroads where I have to decide how much of a prick I really want to be to this kid. Here are the options that I am considering: 1: Allow him to make final payment then send him the license and 2257 and call it good. 2: Demand final payment but not give him anything simply because he has infringed on my copyright and thereby violated my license agreement which is cause to terminate that agreement. 3: Sue him for the infringement...And no matter what some of you think...He has admitted to the infringement and we all saw it so that liability does exist. 4: Sue him for the libel things he posted about me. (yes, I know this is GFY but if you are going to play hardball with me, you should make sure you are prepared to play the entire game to the end.) 5: Options 2,3, & 4. sonofsam doesn't seem to see any fault in what he did yesterday so it's kinda hard for me to find any reason whatsoever to cut him any slack. Besides...After what he did yesterday, it's not like anything I do will make me look like less of an asshole....Soooooo........? At this point...I'm pretty much leaning towards option 5 more or less because even today, his attitude has not changed a bit. I owe him nothing until he finishes his payments....And legally speaking....I don't owe him anything after that now that he has taken the actions that he has chosen to take. Can anybody tell me why I should allow somebody to piss in my face after I have helped them out....And then continue to help them afterwards? Decisions, decisions, decisions.  |

He's screwed up many times... no doubt. But none of it, at least it seems to me, has ever been with the intention of screwing over anyone, or taking advantage of anyone. It's always just been very poor judgement on his part.
That doesn't mean he should or shouldn't be given any favors... I guess you just have to evaluate for yourself.... someone who is naive and unaware of proper procedures... do you a) give them extra breaks, a few do-overs... chances to redeem themselves in the hopes that they will learn. b) give up hope that they will ever learn... let them go on their way on their own to grow and gain experience... and forget about him. c) teach him more of a lesson... he's been given breaks already, so give him a hard core lesson that he just can't keep getting away with this stuff. If it was a clear case of him just being harmful for the sake of being a prick, then the choice would be obvious. In this case, I'm just not sure. |

I'd pick #1. Once he has sent full payment (of the initial agreed upon price, not discounted slightly, like you were thinking the other day), send him the shit he needs. He can't do anything with it until he gets it anyway.
And keep an eye on him to make sure he doesn't do anything with it until you have received payment in full. If he does try to use it before sending payment then follow up with options 3 & 4. In my opinion, if you get "sue happy" it will scare away a lot of potential customers. Just speaking as a neutral 3rd party. |

hmmmn.
i'd say get the money, give him the 2257 and get him out of your hair for good. i've been some similar situations over the years and its always better, less effort, and takes up less space in your mind to get whats yours and get rid of whoever it is for good. as far as the infringement, i haven't seen the whole other thread, so because you aren't really someone who makes shit up, i believe you on it. i'd tell em they have a very short period of time to correct the infringement to make it all good, (unless there was money made with the infringement, then you are entitled to whatever % would be yours), and call it a day. we all have too much stuff to do, unless this person caused you so much anger and sleepless nights over the situation and it would make you feel that much better by going with option 5, i'd smash it and get it overwith. now if this person doesnt want to make right option 1, then he has issues and would probably get option 5 from me too. |

i would say go with option number one. the time and $ you spend in court could easily make you way more $ if you spend it shooting content. i'm sure he has done enough damage on his reputation as it is.

I think it would be fair to say that other options would cost more money than the price sonofsam paid (or would end up paying). That's without accounting for the time it would take to file a suit.
That being said, I would suggest option 1.
