My point is that based on his actions I dont necessarily want to do business with him,
nor does he seem to want to do business with me as he has not contacted me
as well has he has ignored my icq's. (See above post "he must not be that sick since he is ICQ'ing me now..." yet he never replied. I take that as he doesnt want do clean up this mess.)

I'm still open to discuss this with him. I suggest we let this thread die until we come to agreement. i will post no more about this until i speak with him directly.

I don't normally butt into these bashing threads, but here I go. I have read the whole thread. At the end of reading this thread, I asked one of our guys if we hosted with Split Infinity, and we don't. We have several hosting accounts, so I am not always sure. Anyway, I probably would have suggested moving that account if we would have had one. You say you had the money to pay it, but just didn't feel comfortable doing so. That was wrong. Then, you bash DB (who I don't know, nor do I have ANY association with) for being upset, and bringing this out publicly. That was wrong. THEN, you say you are not going to pay him money that you already owe him. Not money for future payments, but money YOU ALREADY OWE HIM. You seem to have many friends, and supporters, which means you are probably a very nice guy. But, business being business, I am sure that the next time I am looking for a host, SI will not be on the list. The only reason I am bringing this to your attention, is to possibly save you from losing any more future business. The best thing for you to do at this point, personally and professionally, is to pay what is already owed. This, of course, is just the opinion of what was a potential customer.

Sorry about your hospital visit...I am sure it was extremely scary, and I wish you the best of health in the future.

Chris, my partner has contacted you to work out a settlement.

If you don't work out a settlement with him by tomorrow night, I'll be letting the dogs loose on Monday and suing you for the full amount.

I will make it my full time job to go after you for the full amount agreed upon in the contract to teach you a lesson in both professionalism and the power of agreements.

If I have to pay the lawyers $20k to get that full amount, I won't bat an eye. Principle is very important to me. You make a deal, you follow through.

More than anything else, you've made this worse for yourself by continuing to blame me for wanting money for the domain you contracted to buy, and benefitted from (without paying).

I hope you come to your senses and work out a deal. Why none of your friends haven't taken you aside to slap some sense into you as your business goodwill walks out the door is a mystery to me.

As I said in the other thread, I now think that you threw a hail mary with this, buying the domain on time and reputation, and praying that by the time you had to make the first payment, you would have garnered enough traffic and publicity to make it worthwhile.

It's clear you don't even have enough in the bank to wire me a proper $5k payment, but instead try and send me $4k (if you sent it at all) when the agreed upon amount was $10k.

Not my problem. If you haven't realized already, your rep has suffered a terrible blow. Make it right before it's too late.

I wired him money, I did what I said I was going to do... Wire 10k at the end
of the month. He has 4k and still denies it, I do not understand why he would expect
the other 6k to not get yanked while he still continues to bash me.

In the end.... you guys are teaming up against me... I never "bashed" him until
he started to get a bit too into this. I have tried to make peace with this guy,
yet he continues to post... so its obvious to me at this point what he is all about.
Why dont you contact me yourself? WHy dont you admit you received funds?

If you want a settlement, then quit your posting bullshit. You are the one who pulled your trigger.... I sent you money, you went to the boards despite that fact. I have made every attempt and have never backed out. This is my fault, sure.... But how you reacted is no excuse for going overboard like you have.

I never backed out of the deal and had he not started this thread we would not be in
this mess. So one question for him is all I have.... Do you or dont you want to continue with this deal? Thats all I ask..... if the answer is yes, then I will agree to let all this be behind us....

No, I don't have $4k you moron. My bank account shows nothing. How many times do I have to say this. You haven't paid me until it's in my account. You have no credibility with me or anyone here now.

On Monday, I will tell you whether I received the wire or not, taking you from having paid me ZERO to having paid me $4k.

Then you'll still be $6k short.

You pay me the full $10k and I'll CONSIDER restarting the deal, but the plain truth you have to digest is that you don't drive on this one. If I choose to nullify the deal after you send me the $10k, there's not a goddamned thing you can do about it because you violated the terms of the deal.

But that might be better than me spanking you in court for the full $45k, which would most certainly put you guys down for good given your serious lack of cash flow.

My suggestion is you start talking to my partner before I swing the door shut for good and sue you for the full vig.

Chris, I have no direct interest in this on any side, but let me give you some good business advice:

When you have announced all over that you bought the domain, that you have done a great deal, yadda, yadda... you need to EXECUTE. Failure to execute on a simple "send money" situations can make people wonder about your ability to execute on anything else.

You bought a domain to brand your company and make it easy for people to find you. You agreed to a price (which is a good price for both parties, i am sure), now all you have to do is pay. Pulling back the second wire isn't helping you out here.

Your doing this in public now, and you only get one chance to make a good impression.

I bank with BoA, just print (or screen grab) of your current activities and black out the important info to show that the 4k was deducted and post it maybe some us will believe you. The screen shot I saw of the bank transfer, I could make that in PhotoShop and I also could change my fax number to any number for the receiving end.

I don?t know and it might be not my place to post this, you owe the money and say you have the money so why not pay it. These threads don?t look good for new clients especially when the search is working

dombuyer- i recommend you mitigate your damages soon and relist the domain for sale. that can fairly reduce chris' exposure at least. contractually he is a bit fucked of course. ease up a bit. your position is obviously strong.

chris- i think todd's point earlier was that you seem to know a lot about hosting and need some more corporate backing to get to the next level.

i hope people are not turned off to the 3rd party aspect of domain brokering. the folks in the middle are partially to blame for failing to verify that their client for purchase was in a position to pay per the contract.

most of the other points about executing and contracts and publicity have all been touched on and are obvious.

good luck to both of you resolving this and moving forward.

I appreciate your kind words, but I hope you can understand that I ain't taking any flak in any direction. I have been in the business of domains for a long time, and both the negotiation of the contract and the conditions attached were in keeping with the guy on the dotted line and his rep. Aside from peering into someone's bank account, there's no way to know if they'll follow through.

I think that when a company's in trouble, they'll cut almost any deal to pull them through, and will let their standards slide. Sinking ship and all.

seems totally standard in the domain biz and this is really a behind the scenes look at what happens in domain transfers etc.. it would be interesting to see the contract and also i wonder if chris would have wired you upon signing if he did not have the domain pointed to him until the first payment had landed.

to turn this into an educational do's and don't's for domain buyers and sellers would be a somewhat positive spin and you and us take these formalities for granted after having been down these roads over the years.

confidentiality etc in the agreement may preclude you from posting it but it could be a good tutorial. if anyone ever wants a copy of our standard domain transfer sale agreement/contract please email us and we will provide it to you as a courtesy.

now somebody send me their super model contract template for single girl sites ;-)

Now we get to the sorest of spots: this fiasco reducing the goodwill of the domain. It's one thing that I had to go through all this b.s., lose that traffic, actually pay someone to draw up and monitor this sale and end up in the red (so far) but what most pisses me off is that when I relist the domain, a lot of people are going to be thinking twice about taking it off my hands given the drama. Just the whiff of potential problems/lawsuits/bad karma will keep the big boys away.

I know I'd be very reticent to buy this until the dust has *completely* settled, and I know many others will feel the same. That's the worst of it.

Hmmmm Xpays, I like the way you talk.... that was a clear a level headed post.

Anyways, we do not have cashflow issues, that is not the problem at this time.

I have been on the phone with logicbank and the call ended well.
I highly recommend logicbank for and brokering deals... the guy is a GREAT negotiator.

I also strongly belive after my phone call with him that this can and will be worked out. I agree this got out of hand...

totally valid and true - google split.com someday and this thread will pop -up if the buyer goes that route. plus you have illwill on it - hand it off to sedo this one time

also - if chris can secure the contract somehow and add a couple bucks to it and stretch it out a little longer and then stick to it- it could be pheasable.

will email you and turn up the volume - side note- we have never missed a payout (through sponsors going belly up and ibill shorting us etc.) - which is another good reason to use us--- we pay out of pocket without gvetching if a sponsor or provider sticks us. you never even notice and another working site in the same niche usually will automatically pop in to your original link. all your links will work for as long as we are in business and our 7 year anniversary for XPays is august 5th.
