I was sure this thread wouldn't die like this and it's up again. After reading the last posts I'll agree with Incognito concerning TOS and this is probably as a result of copy/pasting the TOS of someother sponsor. If someone goes back 2-3 pages of this thread he'll see my comment that I agree not to notify a webmaster about his illegal activity and I explained the reasons. Sponsors recall TOS when it comes to terminating accounts and denying payments. This is acceptable. But, you MUST state certain things on your TOS to do so and not take them out of your head. I have read the TOS of adult.com and I'm sure Lensman's people actually worked on it from zero base instead doing the common thing many of sponsors do: taking from others both TOS and privacy policy. If Incognito is right and you do not state the non notification of the webmaster, sorry but actually candidclicks you're the one that breaks your own TOS. For the ones that will be ready to say "so? big deal" i'll remind them that TOS is part of a mutual contract that both sponsor and webmasters have to follow.

I'm curious to know how many sponsors had their TOS checked from a lawyer. It will be funny to do a research and see that INDEED some of them copied even the last word from another sponsor

It's even funny.
They dont TERMINATE his account - they just dont pay the guy because he violated their TOS violating themselves it in the same time. When his only real fault is not sending FAKE hits for example but sending wrong kind of traffic. Now if You ask me what's a worse crime to keep someone's money or to send excuse me wrong traffic (and not CHILD PORN by the way, TORTURE traffic the guy had) I vote that we all know who's the cheater here. |

If you take your TOS seriously you know that stating or not something is really important. I don't want to take it as a personal attack because honestly it's not. You can avoid future similar situations by stating with bold letters that WE WON'T NOTIFY YOU IN CASE OF ACCOUNT TERMINATION. Period. Webmasters that promote violence sponsors do know they can't promote on the same site many of the well known sponsors and i'm sure they read the TOS of the sponsors they join unlike many others. I'm with you on this case. Neither I would like a rape link or banner in the same page where the webmaster promotes my future sponsor program. Afterall, a straight stating of it will eliminate or at least decrease the possibility of having webmasters promoting this things to join your program. |

If you have read all seven pages (just like me) you probably are surprised with the impact this topic caused. "Candidpublishing are deceivers". 7 pages long. Damn. I expected to see something like a new season of "the Simpsons" or "the X-files". Now, talking seriously, I should agree with my russian fellow webmasters (yeah, I am russian too). Instead of admitting their own mistakes, candidpublishing prefers to make their "good" name with black PR just throwing dirt at ex-partner's face. (cos every webmaster who work with a sponsor is a partner, right?) And their reputation is so "solid" that their cannot afford paying 150 bucks to the guy who didn't anything wrong. Hey, webmasters around the world, are you going to work with a sponsor who prefers to make long discussions instead of just paying you the money you worked for? I have made a note for myself: candidpublishing's name ISN'T WORTH 150$. (And guys, I also disagree with your viewpont - gallery posters are NOT lammers.) |
