God Save Us All. I'm Hosting Sites.

I had a very long talk with an old veteran in the biz about the troubles I've had in the pasts with hosts. I have a 3 page list of who's cool and 10 pages of total douchebags. I don't want anyone to have the same trials I've had. So...

Sweet. Appreciate it. Actually, have one question. I've been getting mixed answers.

One of the things that really got me was the nature of responsibility in owning a large forum. People will post obscene messages, link to warez sies and post copywritten materials, whilst the disclaimer upon signup- that clearly states not to do so.

What's the time frame the DMCA gives you to remove an infringing image after publisher A files a cease and desist notice?

Thats all I ever see you being...As unless you got some money and skills...You ain't gonna be able to launch a full blown hosting company...

The most common thing server masters do is dissasociate themselves from their hostees in thier terms of service. "By paying for hosting with us you agree to accept all responsibility for all content on your site. Server claims no affiliation or responsibility for content produced, uploaded, or maintained by hostees" Something along those lines. Lawyers will usually go after a site owner before they go after the host. But once they do, they will usually outline the time they will give you to remove the content. The DMCA says they have to give you all legal avenues and terms. It doesnt give a set time I believe. You can read more in Article 12 of the DMCA. But thats basically the jist of it.

Anyways...DMCA notices are just companies ways of warning you...They don't have to send them...But in most cases the problem can be fixed without going to court...

If a company wanted to...They could directly sue a site without giving a DMCA complaint...

Now the hosting company would NOT be liable if the company could not prove that the hosting company was willingly and knowingly hosting such content for their client...Once the hosting company is made aware of the issue...They become just as guilty as the client...But the DMCA terms protect the hosts so they don't have to police all their clients. As that would be a fulltime 24/7 job for several people depending on the size of the host...

There is no terms on how long you have to remove the content...You wanna kill the content asap as the DMCA is a friendly way of saying do it fucken now or else...

I am not giving out legal advice...You should always consult a attorney before getting into a business and figuring things out...As GFY is not a good way to base your business and liabilities on...But you can get the gist of things

Yea, that's cool. It's like the same agreement for users who sign up to a forum. I'm not gonna shut down a webmaster on account for what his users post on a forum. Fucks sake, they don't know any better. They're just sharing pics. Like this board.

Why do they even write the hosts? I have no idea. There is no reason for such nonsense. It's bad enough that they can't take it up with the user who posted it, let alone the webmaster.

Because hosts won't let themselfs be responsible for users content...So if you want the offending content taken down...You speak with the host...Most users will ignore your emails and act like its nothing...

Hosts HAVE to take a stance on such situations...As it risks their business...There are ways of handling this complaints without taking users sites down...Giving users at least 24/48 hrs to handle the complaints...

But taking no action WILL get hosting accounts shut off...But of course you have to have a decent amount of notice...24-48 hrs seems suitable...

With me, I had a case of harrassment. One of my compeditors was trying to be a bully and shut me down. He wrote my host; saying he was 'so and so' and to remove certain images including thing that were MY OWN FUCKING CONTENT!

Indeed. As I said in that last topic, when it happens to me I write the lawyers back asking for a little bit more info and I inform them that I will tell the hostee in question to remove the content. I give my hostees around 48 hours before I remove the content myself. It depends upon how angry the lawyers are. Some are very nice, some are on a warpath. You just have to gauge the urgency of the situation. In any case, you become responsible as a host once informed of infringement no matter what you say in your TOS, so removing the content yourself is your only resort if your hostees fail to comply.

In my last case of harrassment of webmaster A; if I wasn't avaliable in 5-10 hours, the host would shut me down. Before I could even explain the situation. Which I consider to be total bullshit because, like you said -that could be a 24 hour job. I don't sit around my computer waiting for email, let alone check it on the weekends. and 2) It's the webmasters responsiblity to deal with it, not the hosts.

Yea, 48 hours seems good.

I agree with your being pissed off in that little bit of time...

Also keeping good communication with your host is crucial when you even suspect your sites could be DMCA'd...Webair has my cell phone number and all my email addies...If a situation would come up...They would wait to get up with me before taking action...(To a resonable amount of time)

24-48 hrs seems to be enough time for most to take care of the issue...

The sooner the better of course

Plus no one ever disables the website...Just the content in question...Perhaps chmoding the image to 0 till the user is online and can fix the situation...

So you might have a red x but at least your site is still online...

Cool another clueless hosting company. Just what this board needs. I'll even help you out and push people your way so after you host them for 2 weeks before you get shut down they will come back to whereever I suggest with smiles on thier faces.

BTW Dumbass you are a reseller unless you:

Own your own routers and switches.

Own your IP block.

Own your own equipment.

None of which you even have the mental capability of doing. Good luck I promise I'll send customers your way. I have this russian that only copies his content from playboy and flint digital. I'm sure you two would get along great.

And I have read your posts above you have the recipe for disaster. I pity any hosting clients you pick up.

Yeah. If you want to be succesful, keep a good repoir with your hostees. Alot of them dont think twice about giving me their phone numbers and stuff so I can stay in contact. Just try to stay in contact. Its all you can do.

Edit: As far as that reseller bit. Thats not entirely true. I own my server, its just out of house. Have you not heard of a server farm? There are lots of them. You buy your server and they will house it, take care of it, and let you use their connection. So I dont have my own routers or switches, or IP block, but I dont consider myself a reseller.

It's not so much the 10 hours that pissed me off, but more so his incompitence and little faith in me. Upon taking me on, he knew I had issues. I CLEARLY made that known- and he clearly made it known that he was a strong enough host for the job.

But he was easily swayed. Make be wonder if he was bought off.

Cannot stop attacks? What does physically owning the router have to do with stopping attacks? I have full SSH and I am in phone contact with them.

Please enlighten me.. you are obviously much more experienced then me. Is there some exploit that attacks routers that arent paid for by the server owner? Please inform me of this amazing leap in exploitatious technology.

Edit: Way to be. I have been doing this for 7 years. CFX is just the newest host I have started, and It is were I have been focusing my attention. Jesus, how about instead of trying (and failing) to poke holes in what I say, you say something actually insightful. Swing and a miss.

Congrats. I am only 17. I dont think it would be possible for me to do it much longer.

And before I get another smartass comment, I'll address it now. Yes, I have been doing this since I was 10 (11 actually, but who cares.) I had an older friend who had been doing it, and he helped me out and in return I taught him what little Visual Basic I knew. I just kept doing it from there. But I'm sure you STILL have a smartass comment.
