Ok lets see...

I paid Andrew $10 an hour Canadian and he *worked* (if you can actually consider what he did for us work) 40 hours a week.

40 hours x $10 = $400

He worked for us like 2 1/2 months so that is 10 weeks.... So that adds up to about $4000 plus the week severance I gave him so $4400.

Are we out of small claims yet? LOL!

And it would be for more, because that's what happens when theifs aren't caught or had the whistle blown on them, it just progresses. You were wrong and admited to it. In Canada you will be awarded Party and Party Costs if you win.
And you would if you specified a geographical scope, as well as a scope of how long he is not allowed to compete with you.

If you do not provide that, the courts will most likely provide a scope for you and declare you the winner :thumbsup

$4400 is still small claims. You're going to sue him to get back money you paid him because he stold a partner account?

You've ruined his reputation. Rather, he's ruined his own repuation. People will know about him now. You can't really hope to collect any damages from an 18 year old kid who made 10 sales in total. It's beneath you at this point. Arguably, a point could be made that it's a principal, but he's already admitted to doing it. There's nothing for you gain or prove in this case.

Fuck this guy, karma will come around harder than any Canadian court ever will :)

Honestly, if I didn't expose Andrew and let him get away with it what would that say about me. My current employees would then think it would be "ok" to do what Andrew did and there would be no consequences to their actions. I'm not saying any of the people that work for us are theives in the slightest but at the same time I have to make examples out of people that steal from me.

Anyways long story short this guy, signed a non-compete with our company and he is in strong violation of that contract. In addition we have concrete proof of him using our partner accounts.

Please be wary of hiring Andrew as he cannot be trusted, we are now pondering what legal action we should take. What would you do if you were in my situation?

Industry standard. When I used partners I didn't mind them buying 5 accounts... I made 5 times the money.
