Atlantic City hotel and casino says it will fire any cocktail waitress if she gains too much weight.

Atlantic City hotel and casino has a new policy: Fat waitresses are sent packing. CNN's Jack Cafferty reports.

NEW YORK (CNN/Money) - An Atlantic City casino said its cocktail waitress could lose their jobs if they gain too much weight.

The Borgata Hotel Casino and Spa warned its female servers, also known as "Borgata Babes," that they could be suspended from their job if they fail to maintain their sexy figures.

The company told CNN/Money on Friday that the new policy applies to anyone -- including male bartenders -- who gains more than 7 percent of their body weight. But if the weight gain is caused by pregnancy or a medical condition, the company said, the server would be exempt.

"We find this policy to be legal and fair, because the job is defined as a 'performing art' profession at Bogata," Borgata spokesman Michael Facenda told CNN/Money. "Our guests have to come to expect a certain level of service and appearance, and it's our intention to maintain (that image)."

The policy infuriated women's rights advocates, the cocktail servers' union and others, who call the move discriminatory. The cocktail waitress union is also filing a complaint against the new policy. But so far no legal actions have been taken.

This is so stupid. I mean I understand they would like the girl to have a nice presentable appearance, but to lose a job over not looking thin, is stupid.

i disagree ... there should be standards set, and they should be followed. for years many top bars / clubs simply wont even interview ppl not fitting the mold. so you get hired at a place that is trendy and full of hardbodies and expect the extra trim to be acceptable?

Why is it stupid? People love to see slim girls over chubby ones, it is a fact. It's not hard not to get fat, just control yourself !

Restaurants have good looking employees for a reason. Nobody wants to go to a place where everybody is ugly.

This is the reality of life. People like beautiful people. We make a living off of that fact!

Hooters should adopt a similar policy. Some of the ladies they hire and throw in those tight clothes... erm.

Not too mention hooters really needs to reconsider the attire they make them wear! You ever notice that those waitresses always look better when they are in normal clothes before and after the shift?

Not that I have sat through hooter's shift changes or anything...

Good for them. I think discrimination is only discrimination if you have two equal potential employees and hire one because your prejudiced against something with the other. In regard to the business at hand here, "potentially equal" includes how you look and not just how well you can serve.

Last time I checked, being OVERWEIGHT is not a protected characteristic like race, disability, etc under US discrimination laws. California's CASSISTA case holds that OBESITY can only be protected under the state's FEHA employment discrimination regime IF and ONLY IF the obesity arises from, results from, or is connected to a DISABILITY that is protected under FEHA.

I totally agree. If I had a business that required hot waitresses to make money I would require that they be hot, or else the business would close and both I and the fugly waitress would be looking for a job.

Which unfortunatly is very easy to accomplish with the right doctor and excuse/injury.
