Last time I checked, being OVERWEIGHT is not a protected characteristic like race, disability, etc under US discrimination laws. California's CASSISTA case holds that OBESITY can only be protected under the state's FEHA employment discrimination regime IF and ONLY IF the obesity arises from, results from, or is connected to a DISABILITY that is protected under FEHA.
