so the 2257 won't affect that TGP at all.

But on the other hand, my first tgp, legally18.com ...it will be affected. I might have to go to text only, or crop around the face.

Actually I'm pretty sure there was a case in the past where the court ruled that using just thumbnails fell under the fair use provisions of the copyright laws.

Of course that doesn't make the sites legal regarding 2257, but I'm pretty sure it covers them on the copyrighted content issue.

Yes, ofcourse that tgps need to comply, this is already understood.
I dont think a tgp like madthumbs will trust submiters to hotlink from them....

You're telling me that google's thumbnails aren't the same 'content' as madthumb's thumbnails, and that they aren't 'inserted' in the same way?

And for everyone in this thread that has said 'crop it around faces' ... that's not correct. You can show full nudity if you want ... the only thing that falls into 2257 is sexually explicit.

Myself, if I had it my way from the beginning .. ALL of my thumb tgps wouldnt show a bunch of dicks, fucking, cum, etc .. but would show some faces/tits/ass etc .. but not the whole shabang .... this does NOT hurt productivity, it actually increases it because the surfer will click more (not knowing whats on the other side) ... it's the same as using a gallery to lure a surfer to a paysite ... the thumbnail on a thumb tgp should be a sample that does everything it can to peak the interest of a surfer. Pretty simple.

Anyhow as of September 24th on MadThumbs:

a) You have to submit softcore non-sexually explicit thumbnails.

b) You have to censor the hardcore parts out of the thumbnail.

c) For a paid listing on the mainpage that actually wants to continue submitting hardcore, they have to provide the documents I need to be in 2257 compliance.

Regardless, this is all hypothetical. I've got several legal questions about all of this that can't be answered untill some precedents are set.

Like someone mentioned above, how are they going to hold be liable for 2257, if copyright law makes 88x88 thumbnails legal?

Doesn't make a lot of sense, but we'll see.
