Hate to bust your bubble on this, but you are wrong. I thought the same thing initially, but had a lawyer hit me with something that is now obvious:

Hot linking / linking etc, places you in the "enters into a contract, agreement,or conspiracy to do any of the foregoing..." category. It is vague as hell - on purpose, and that is their catch all.
