Think about this:
In the 1980's AIDS was a death sentence. And it was an epidemic. Nobody was sure what the hell was going to happen next.
John Holmes...arguably the "biggest" male porn star of all time, even died from it (along with a few other IV drug user/performers).

Nobody called for "mandatory condoms" or for the govt. to get involved or blamed producers for people's "safety" when they are filming people fucking.

By the time the 1990's got around, if you got diagnosed with HIV you could take medication and stop it from ever becoming AIDS. It was no longer an automatic death sentence.
People have been living with it for decades and these day take ONE pill a day. Just like taking a vitamin in the morning. They are perfectly healthy and live normal lives.

And in the 1990's, nobody was screaming all this bullshit. They didn't even do mandatory testing.

Mandatory testing didn't even start until a few years back.

I just think that everybody should stop knee-jerk reacting and take a deep breath.
Testing does allow folks to stop the spread of it. (too bad that "civilians" don't test every once in a while too)

You're never gonna stop people from doing IV drugs and sharing needles. It's just a fact. Been happening since our great grandparents were young.
You're also never gonna stop guys from fucking other guys. It just happens. Nobody wants to admit it...but it happens all the time.

And you have to keep in mind, these guys and girls who are "performers" work in the sex industry for a reason: They are good at fucking, and they enjoy fucking a lot more than the average human being.

You can't expect Michael Phelps to not go swimming when he's not doing the Olympics. He probably is in a pool more than anybody on Earth. LOL
And you can't expect good looking, young people to not fuck and have fun.

All of us can rail about it and demand that they always use condoms (which is the WORST sex in the world...you can't feel shit) on set AND in their personal lives.

They won't.

And you can't blame a guy holding the camera and paying out the money and taking all the legal risks when you have extremely sexual people who voluntarily are fucking in front of your camera.

If you really think about it...minus the knee-jerk reactions and "outrage", it's kind of silly to think that anybody can command people to wear a condom or not fuck in their private lives.

It's a goddamn miracle that people are willing to allow blood to be drawn and their medical records passed around like cliff notes.

But what isn't silly...is ALLOWING the govt. to take step one into our sex lives.

Our founding fathers NEVER envisioned that.
And before you tell me that AIDS didn't exist then, I'd like to remind you that Syphilis & Gonorrhea were death sentences up until antibiotics were made.

I don't recall George Washington or Thomas Jefferson saying that the govt. had any right to tell prostitutes of the 18th and 19th century that they had to wear a condom.
Because they KNEW it's not the govt.'s place to do so.

It's YOUR place and MY place to make that decision for OURSELVES. And not for others.

Giving govt. the right to force you to pay them big bucks for a permit doesn't make anybody safer. It just puts money in corrupt politicians hands. And then if you do make any money off of your work, they will double dip and tax you on top of it.

It's one of the reasons that people have so much trouble setting up brick and mortar business in city limits. Everybody has their hand out.

We opened a used car lot and a restaurant/bar when I lived in South Carolina a few years back.

After a lot of due diligence (almost a year), we opened both businesses just outside of the city limits of the town I lived in. It was way too much hassle and expense to run inside the city with all of it's "permits" and "fees".

I think I'd probably leave the country to shoot if we allow the govt. to just take over our business.

I do agree that if folks want to use a condom because it makes them feel safer...they should be able to.
And I should be able to choose whether I want to shoot condom porn or bareback porn.

I will also say, that IF a concensus were to develop that everybody wants to start shooting condom only and keep the govt. out of our lives...then I would go along with it.
It will definitely suck balls though. Not only does it destroy the whole "breeding" niche for interracial sex, and takes away the fantasy aspect of porn...but it also would leave Claudia Marie very sore because a lot of guys take forever to cum when they have to wear a condom.

A bar and a hotel room are two different things. A bar is a public place that is highly regulated for people to get drunk. A hotel room is where people sleep and fuck in private.

In each case, the virus was acquired offset and was prevented from entering the performer pool by our testing system (known as PASS).

Like a ringing car alarm, a moratorium is a sign of a working system, not a broken one. Adult performers ? like all of us ? have personal lives. We cannot control, and should not look to control, people's private lives. What we can do is make sure that HIV is stopped at the gate by testing protocols.

Once a moratorium is called, all production stops so the genealogy of the virus can be traced. The performer who tested positive is interviewed. All sexual partners ? on-screen or off ? who fall within the transmission window are contacted and tested. This allows doctors to trace the transmission history of the virus: how it was acquired, if any other performers were exposed, and if there is any further threat to the performer pool. What doctors don?t disclose is the performer?s identity.

Sadly, almost immediately after the moratorium was called, members of the media began searching for the positive performer's name, in what can be described as a witch hunt. This weekend, on social media and on blogs, a man was 'outted' as the positive performer. This is disgraceful.

First, we don't know if the named performer was the source of the positive test or not. HIPPA regulations rightly prevent the testing clinic from disclosing a patient's identity to anyone, even the Free Speech Coalition, unless the performer allows it. And we shouldn't need to know a name. We only need to know if people are at risk. Everything else about the performer?s health should be between the performer, that performer's partners, and a doctor.

HIV is a virus, not a moral issue. Yet both blogs and mainstream media unwittingly rushed to blame the victim. By assuming that adult film work is responsible for the virus, the mainstream media essentially resorts to slut-shaming. On the blogosphere and social media, it can be even worse ? unfounded assumptions about escort work, or drug use, or "cross-over" sex (that is, sex with men or transgender performers) are the most common scapegoat.

At a time when we most need to support someone in need, we rush to find a villain. I understand that at a difficult time like this, everyone wants to find an explanation. But in doing so, we must respect the performer's privacy, and restrain ourselves from moralizing over a medical issue.

Whoever the performer is, we need to be there to support them ? not shame or attack them. No matter how the virus was acquired, the performer is one of our own. If the performer does choose to speak publicly, the industry needs to rally behind him or her ? perhaps provide interim support or help find work elsewhere in the business.

An adult performer who tests positive for HIV faces not only a life-changing diagnosis, but the loss of his or her livelihood. If we truly care about performers, we need to do so not only when they are on a box cover, but also when they are at their most vulnerable.

Any positive test rightly spurs discussions as to how to make the industry safer for the performers. (Currently, every fourteen days, a performer must be tested for a full slate of STIs, including HIV, in order to be cleared to work in adult film.) We can have honest disagreements as to how to best do this.

I only ask that these discussions involve the performers themselves, rather than politicians and pundits who sometimes claim to speak for them. We have a vital, intelligent, engaged performer base with strong opinions about their own health and sexuality. We ? the media, the industry, the doctors ? need to listen to them, and accord them the respect they deserve.

Over the next few days, we'll learn more about the current positive test. If the virus was prevented from entering the performer pool, retests will begin and the industry will slowly return to work.

I only hope that the discussions that come are substantive, not sanctimonious ? and that everyone remembers that we're dealing not with a cautionary tale or a talking point, but a real person who is struggling, and needs our compassion and support now more than ever. Thank you.

The problem is that the people who are over reacting are people who want others to protect them. I get where you are coming from, and I'm the same way, it's my life and I'll deal with the consequences of my actions. He did so thinking that his test was fine and that there was nothing to worry about even though he had been told to come in and retest because ?TTS doesnt like to have inconclusive tests on the books?.

He chose to retest at CET instead and was notified by CET on Friday, Dec 6th, at 1030 AM (approx) that he had tested positive for HIV.

He said that he has never in his life escorted and that any ads that appear to be him are fraudulent.

He also stated that he has done NO cam shows in the last 6 months and that all of his sexual partners, both on and off camera since October 1 have been notified and have retested at CET.

Now lets talk about that first generation exposure list. I have more than one person who says they had direct exposure to TJ Cummings in November and have never been notified, they only found out from my blog that they had been exposed. Lukeisback has a similar story, I have no idea if the people are the same ones. But I have a pretty good idea that the exposure list is FULL of holes.

Lets face it TJ has been less than forthright in this whole thing, it certainly wouldn?t surprise me if he ?forgot? some of these encounters.

But there?s even a more glaring hole.

Who would be the best people to consult to find out his on screen exposures? Maybe the agents?

I talked to a LATATA Board member tonight and was told that LATATA has had two long meetings in the last two days and one of the topics is that not one single LATATA agency has been contacted to help with an exposure list. EIGHT Licensed agencies and not one was consulted?

For anyone crying ?privacy? thats stupidity exemplified, TJ Cummings has already given me an on the record interview. I would like to point out that AVN and XBiz have yet to acknowledge that he is the infected performer, when i asked Helmy at XBiz about this his response was ?We believe in privacy? Ummm he has already come forward man?himself?.In a public forum. You are waiting on permission from The FSC to make this public? REALLY?

On set he was told he had a ?reactive? (not positive) test result and to come in immediately as they needed a second sample to conduct a new test. He refused to do that and went to CET the next day,

Since Los Angeles County's condom mandate for pornographic film sets passed last November, the adult film industry has been fighting it tooth and nail.

After an initial campaign against the measure failed to convince voters, some companies and performers challenged the law in court, claiming it was unconstitutional (and with some success). But the vast majority have moved their shoots outside of Los Angeles, or at least don't file for permits with the city.

However, with the announcement that the fourth porn performer since August has been diagnosed HIV positive, the adult film industry should consider a radical new strategy: Embracing the law.

The protocol for the heterosexual porn industry has been to eschew condoms for regular STD testing every 14 to 28 days and halting production whenever a performer tests positive. The method has actually has been praised in the past. Dr. Allan Ronald, a Canadian AIDS specialist, told the New York Times, "I don't think there's any questions that it works."

Indeed, the few times performers were diagnosed as HIV positive in the past ten years, it was quickly isolated and the virus was not found to be transmitted to anyone else the industry.

That is why the porn industry has taken such umbrage at the new law. And as threatened, adult film companies appear to have largely left Los Angeles County. Last month, it was reported that just 24 permits for adult films had been filed in the county, compared to 480 within the same period last year. By either refusing to apply for permits or moving shoots, the county has lost hundreds of thousands of dollars in tax revenue.

But while the industry has thumbed its nose at the county, it may only be hurting itself.

This year has seen a relatively huge spike in positive HIV tests among performers. While last year featured a syphilis outbreak, prior to 2013 there had only been two HIV cases in the adult film industry ? one in 2010 and the other in 2009.

Of course, 2013's increase may be an unfortunate coincidence. But the fact that four performers have tested positive since August is disturbing, and suggests the industry needs to be doing even more to manage STIs. (A fifth potentially positive result remains in question.)

For one, it is unfair to performers. Although many of them are against condom use on porn sets, others feel pressure to go along with the industry standards and fear speaking out. Also, aside from the health risks, there is certainly an emotional toll of having to repeatedly wait and wonder. Porn star Aurora Snow wrote at The Daily Beast:

There have been several HIV scares when I had to make those phone calls and figure out for myself how close I was to patient zero. There are no groups within porn protecting performers; it's always been up to performers to keep track of their scene partners, to check tests for themselves, and to make those phone calls no one wants to make. [The Daily Beast]

And not to be crude, but failing to use condoms has the potential to seriously hurt the adult film industry's bottom line. Under the current system, when an actor tests positive, all porn shooting stalls while performers are tested and the cases are isolated. During that period, not only performers, but all crew members are out of work.

The adult film industry has made a strong case against mandatory condoms on set. But now that it has largely rendered the law moot, it should considering voluntarily imposing the condom mandate upon itself.

Never once had an issue with disease simply because it is not worth the risk of cutting corners to make a buck.

The establishment would never allow this. Because they would in fact be responsible by law. The same should be applied to producers. It is your set and your responsibility as to what happens on your set. Do not cut corners in safety, otherwise sooner or later in one way or another you will regret it. Disease or fines.
